ORDINANCE NO. __ 158
AN ORDINANCE OF THE CITY OF ARROYO GRANDE PROVIDING FOR THE
ESTABLISHMENT OF "SET-BACK" OR "PLAN LINE" LINES, AND PRE-
SCRIBING THF PROCEDURE FOR THE ESTABLISHMENT OF SUCH LINES,
AND DEFINING THE EFFECT OF THE ESTABLISHMENT OF ANY SUCH
LINES, AND PROVIDING PENALTIES FOR THE VIOLATION OF THIS
ORDINANCE OR OF ANY SUCH "SET-BACK" OR "PLAN LINE" LINES
THUS ESTABLISHED.
THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE DOES ORDAIN AS FOLLOWS:
SECTION 1. The City Council of the City of Arroyo Grande hereby
finds and determines that the public safety, convenience and welfare
require that from time to time "set-back" or "plan line" lines must be
established along the various streets in the City of Arroyo Grande,
to designate the minimum distance back from the street 1 i nes for the
erection of buildings, walls, fences or structures along both sides of
such streets. Accordingly the City Council by Resolution may from time to
time adopt "set-back" or "plan line" lines for various Streets in the
City of Arroyo Grande, which lines shall be delineated on precise maps
of such stteets, or portions thereof, for which such 1 i nes are so
adopted. A copy of each such precise map shall be designated as
"PLAN LINE, STREET, CITY OF ARROYO GRANDE, and such
preci se maps sha 11 be kept in a book marked "SET-BACK AND/OR PLAN LINE
LINES, CITY OF ARROYO GRANDE", which said book shall be kept in the
office of the City Clerk of the City of Arroyo Grande, and shall be
available for inspection by the public.
SECTION 2. After the adoption of any "set-back" or "plan line" 1 i ne
as set forth in SECTION 1 hereof, no building, wall, fence or other
structure shall be erected or constructed or caused to be erected or
constructed and no person shall erect or construct or begin or engage
in the construction or erection of any building, wall, fence or other
structure within the space between any such "set-back" or "filan line"
line and the line of the Street in front of the property for which a
"set-back" or "plan line" line is so established and designated.
SECTION 3. Any person, firm or corporation or association which
after the adoption of any such "set-back" or "plan line" line for any

street in the City of Arroyo Grande, shall erect, construct or cause to
be erected or constructed, or who shall begin or engage in the con-
struction or erection of any building, wall, fence or other, structure
in the area between any "set-back" or "plan line" line and the 1 i ne of
the street in the front of the property as is delineated or shown on a
precise map adopted as provided in Section 1 hereof, or who shall violate
any other provision of this Ordinance shall be guilty of a misdemeanor,
and shall be punsihed by a fine or not to exceed $300.00 or by imprison-
ment for not to exceed 90 days or by both such fine and imprisonment.
SECTION 4. This Ordinance shall take effect 30 days after its
passage, and within 15 days thereafter it shall be published once together
with the names of the Councilmen voting thereon in the Arroyo Grande
Herald Recorder, and within the same period of time it shall be posted
in three public places within the City of Arroyo Grande,to-wit:
I . City Hall, 214 East Branch Street, Arroyo Grande, Calif.
2. Fire House, 215 East Branch Street, Arroyo Grande, Calif.
3. Post Office, 132 East Branch Street, Arroyo Grande, Calif.

Councilman Hartwig , and on the following roll call vote,to-wit:
AYES: Mayor Burt, Councilmen Lee, Pence, Jacobs and Hartwig
