ORDINANCE NO. /a~
AN ORDINANCE PROVIDING FOR THE PR01ECTION OF THE PUBUC HEALTH
AND SAFETY, REQUIRING A PERMIT AND INSPECTION FOR THE INSTALL-
ATION OR AL1ERATION OF PLUMBING AND DRAINAGE SYSTEMS; CREATING
THE OFFICE OF PI.IJMBING INSPECTOR AND PRESCRIBING HIS DUTIES;
DEFINING CERTAIN 'IERMS; ESTABLISHING nNIHUM REGULATIONS FOR
THE INSTALlATION, AL1ERATION OR REPAIR OF PLUMBING AND DRAIN-
AGE SYSTEMS AND THE INSPECTION THEREOF; ADOPTING BY REFERENCE
THA T CERTAIN PRINTED "WESTERN PIl1MBING OFFICIALS UNIFORM
Pl.lJMBING CODE, 1958 EDITION"; REQUIRING THREE COPIES THEREOF
TO BE KEPT ON FILE IN THE OFFICE OF THE CITY CLERK OF THE CITY
OF ARROYO GRANDE; PROVIDING PENALTIES FOR THE VIOLATION OF THIS
ORDINANCE AND SAID "UNIFORM CODE"; REPEAUNG ALL ORDINANCES
, OR. PORTIONS THEREOF IN CONFLICT HEREWITH.
Be it ordained by the City Co~ncil of the City of Arroyo
Grande, as follows:
SECTION 1. That certain doc~ment in book form, entitled
"Western Pl~mbing Officials Uniform Plumbing Code, 1958 Edition"
is herewith adopted by reference thereto as though set forth herein
in f~ll, save and except as herein amended, added to or altered.
Said Uniform Code and the provisions thereof shall, except as herein
amended, added to or altered .... hereafter govern and control the
installation, alteration, repair and inspection of and the iss~ance
of permits for all pl~mbingand drainage systems in the City of
Arroyo Grande.
SECTION 2. Section 1.1 of said "Western Pl~mbing Officials
Uniform Pl~mbing Code, 1958 Edition" is hereby amended to read
as follows:
"Section 1.l-Administrative A~thority and Assistants
Whenever the term "administrative a~thority" is ~sed
in this code it shall be constr~ed to mean the Pl~mbing
Inspector or the B~ilding Inspector of the City of
Arroyo Grande or either of them or their a~thorized
representative."
SECTION 3. Section 1.2 of said "Western Plumbing Officials
Uniform PI~mbing Code, 1958 Edition" is hereby amended to read
as follows:
"Section 1.2 - Assistants
Whenever the term"assistants" is ~sed in this Code it shall
be construed to mean the as~istants of the Pl~mbing In-
.spector or of the Building Inspector of the City of
of Arroyo Grande."

SECTION 4. Th~ following Sections of said "Western Plumbing
Officials Uniform Plumbing Code, 1958 Edition" are herewith
repealed, to-wit: Sections 1.7; 2.1; 2.2; 2.3; 2.4; 2.5; 2.6; 2.7;
2.8; 2.9; 2.10; 2.11; ll15,subsection (f); and 1118.
SECTION 5. There is herewith created the position of Plumbing
Inspector in the City of Arroyo Grande. Such official shall be
appointed by the City Council of the City of Arroyo Grande and he
shall serve at the pleasure of the Council, and shall have such
duties as the Council may from time to time, by resolution, prescribe,
SECTION 6. Section 1.8 of said "Western Plumbing Officials
Uniform Plumbing Code, 1958 Edition" is amdnded so as to read as
follows:
"Section 1.8 - Violations and Penalties
The issuance or granting of a permit or approval of plans
and specifications shall not be deemed or construed to be
a permit for, or an approval of, any violation of any of
the provisions of this code. No permit presuming to give
authority to violate or cancel the provisions of this code
shall be valid except insofar as the work or use which it
v au thorizes is lawfu 1.
The issuance or granting of a permit or approval of
plans shall not prevent the Administrative Authority from
thereafter requiring the correction of errors in said plans
and specifications or from preventing construction oper-
ation~eing carried on thereunder when in violation of this
code or any other ordinance or from revoking any certificate
of approval when issued in error.
Every permit issued by the Administrative Authority
under the provisions of this code shall expire by limitation
and become null and void, if the work authorized by such
permit is not commenced within sixty (60) days from the
date of the issuance of such permit, or if the work authorized
by such permit is suspended or abandoned at any time after
the work is commenced for a period of sixty (60) days.
Before such work can be recommenced a new permit shall be
first obtained so to do."
SECTION 7. It shall be unlawful for any person to conduct,
carryon or engage in the business of plumbing without first having
obtained a contractor's license from the State of california so to do.
SECTION 8. It is the intention of the City Council of the City
of Arroyo Grande, that said "Western Plumbing Officials Uniform
Plumbing Code, 1958 Edition" shall at all times be in full force and
effect in the City of Arroyo Grande. Recognizing that from time to
time said Code will be amended, enlarged and/or adjusted to meet
changing conditions, the City Council may from time to time by
Resolution adopt later amendments, adjustments, additions or editions

by Resolution. And said City Council may further, from time to time,
by resolution adopt regulations amending, altering, enlarging or
restricting the powers granted to persons, firms, corporations or
associations in connection with or pertaining to the installation,
alteration or repair of plumbing or drainage systems and the in-
spection thereof.
SECTION 9. Three (3) copies of said "Western Plumbing Officials
Uniform Plumbing Code, 1958 Edition" and three (3) copies of all
other resolutions adopted pursuant to section 9 above shall be
kept in the office of the City Clerk of the City of Arroyo Grande
for use and examination by the public.
SECTION 10. Any person, firm or corporation violating any of
the provisions of this Ordinance or of said "Western Plumbing
Officials Uniform Plumbing Code,1958 Edition" or of any Regulations
or amendments to the aforesaid Code or alteration or addition
thereto adopted by Resolution pursuant to the provisions of Section

<--9 above shall be deemed guilty of a misdemeanor and uppn conviction
thereof shall be punsihable by a fine of not to exceed $250.00 or
by imprisonment for not to exceed 90 days or by both such fine and
imprisonment.
SECTION II. All Ordinances or parts of Ordinances in conflict
herewith are to the extent that they conflict herewith repealed.
SECTION. 12. If any section, subsection, sentence, clause,
phrase or portion of this Ordinance or of the said "Western Plumbing
Officials Uniform Plumbing ~ode, 1958 Edition" or of the Resolutions
or regulations adopted pursuant to Section 9 above be declared,
for any reason, to be invalid or unconstitutional by the decision
of any court of competent jurisdiction, such decision shall not
affect the val~dity of the remaining portions of this Ordinance
or said "Western Plumbing Officials Uniform Plumbing Code, 1958
Edition or of any such RegUlation or resolution adopted pursuant

SECTION 13. This Ordinance shall be in full force and effect
thirty (30) days after its passage and within fifteen (15) days
after its passage it shall be published once together with the
names of the Councilien voting thereon in the Hera:ki Recorder a
newppaper of general circulation, printed pUblished and circulated
in the City of Arroyo Grande
