O 0881 2 S 4 5 6 ? 8 9 10 11 12 14 17 18 19 20' 21 22 24 25 26 28 29 30 ORDINANCE NO. 88 AN ORDINANCE PROVIDING FOR THE REGISTRATION OF DOGS WITHIN THE CITY OF ARROYO GRANDE, Ah~ PROVIDING PEN~ ALTIES FOR THE VIOLATION THEREOF. BE IT ORDAINED BY TRE CITY COUNCIL OF THE CITY OF AS FOLLOWS: SECTION ONE. No person shall harbor or keep any dog within corporate limits of the City of Arroyo Grande except as in this ordinance provided and unless the same shall be annually as hereinafter provided and wear attached to its collar a tag as herein provided. SECTION ~0. The City Clerk cf~the City of Arroyo Grande shall annually on the 1st day of July of each year provide, and during the ensuing year keep in his office a bock designated as "DOG REGISTER", in which he shall upon the application of any person owning or having the custody of any dog in said City, and upon the payment to him of the registration fee hereinafter pres~ribed, register such dog by en~-,tering in said book its name.,sex and gen- eral description, the name of its owner or custodian, the number of the tag issued therefore as hereinafter provided, and the date and the amount of t he registration fee paid. SECTION THREE. The City Clerk shall annually o$ or before the 1st day of July of each year procure and during each year keep constantly on hand a sufficient number of tags of a convenient siz and shape to be attached to a dog's collar, on which said tags ~haZ appear the'words "ARROYO GRANDE CITY DOG TAG", together with the proper year inserted; and at the time each dog is registered under the proviskions hereof he shall deliver to its owner or custOdima of such tags. The tags for each year shall be numbered consecutive~ from one upward. SECTION FOUR. Each dog registered under the provisions of this ordinance shall wear a collar to which the tag issued at the time of its registration shall be securely attached. 9 :LO '13 14, 16 17 18 19 ~.0 ~-4 28 ~9 3O SECTION FIVE. On the' first day of July of each year, all prior ~egistrations made under ~the provisions~ of this ordinance shall be cancelled and all tags there~ofore issued shall become and there- 'after be void and of no effect, and all dogs kept or permitted to' remain in the City of Arroyo.~Grande must again be registered. SECTION SIX. For reglst~m~ing each male dog and each sPayed~ dog or bitch, the~CitYm~ Clerk shall collect a fee of '~ne~ ~llar~'. $i?!.00) and for registering each unaltered female dog or open bitch, he'shall collect a fee of Two' Dollars ($2.00), which fees he shall account for and pay to the City Treasurer in the same manner as other City money received by him. SECTION SEVEN. If the tag issued for any duly registered dog be lost or accidently destroyed during the year it is issued, the owner or custodian of such dog, upon making proof to the satisfact- ion of the City Clerk of Its~loss or destruction shall upon payment of a fee of TwentySFive Cents (25~), receive for such dog another tag;Thereupon the City Clerk shall enter the number of the tag SO issued on the register and shall cancel the tag previously issued for such dog and report the number of the cancelled tag to the pouh keeper. SECTION EIGHT. All young, orppppy dogs shall be exempt from th .ovisions of this o.rdinance until such time as they have been veaned from their mother. SECTION NINE. Any person keeping or harboring a dog for fiftee consecutive days. shall be deemed the owner thereof within the mean- ing of this ordinance, SECTION TEN. Every person who shall violate any provision of this ordinance, and every person who shall counterfeit or imitate or attempt to imitate or counterfeit any tag required by the pro- visions of this ordinance; and every person who shall attach to the collar of any dog or otherwise use or attempt to use in the City of Arroyo Grande any c'ounterfeit or imitation of such tag sha] 1 2 4 6 7 8 9 10 12 14 .16 17 '18 20 21 22 24 25 26 27 28 29 30 31 be guilty of a misdemeanor and upon conviction thereof s~ha~! be punished by a fine not exceeding ~100 or by imprisonment not ex- ceeding 20 days or by both such fine and imprisonment. SECTION ELEVEN. If ~ny section, subsection, sentence, clause or phrase of thi's ordinance is for any reason held to he invalid such decision or decisions shall not affect the validly of the remaining portions of this ordinance. Zt is hereby declared that this ordinance and e ach section, subsection, sentence clause and phrase hereof would have been passed or adopted irrespective of the fact that any one or more. sections, subsections,sentences,clauses or phrases shall be declared invalid. SECTION TWELVE. This ordinance shall take effect thirty days after its passage, and before-fifteen days after its passage, it s~hatl be published with the names of the members voting forand against it at least once in the Arroyo Grande Herald Recorder, a newspaper of general circulation published .and circulated in said City of Arroyo Grande.
