SETS, MUSIC BOXES, PLAYER PlANOS, PHONOGRAPHS AND OTHER
MACHINES OR DEVICES FOR THE PRODUCING OR REPRODUCTION OF
SOUND BETWEEN THE riOURS OF TWELVE crrCLOCK MIDNIGHT AND
SEVEN O'CLOCK 1>.;:.., OF 'rHE ~'()t.U\W1IIG :iAOmJiNG IN PLACES
OF BUSINESS; PROHIBITING THE OPERATION OF ANY SUCH DEVICES
AT ANY TIME IN S1JCH MANNER THAT THE PEACE AND GOOD ORDER OF
THE NE1GHLORHOOD is DiSTURBED, AND PROVIDING A P~ALTY FOR
THE ViOLATION OF SUCH ORDINM~CE.
BE IT OHDAlNED by the Council of the City of Arroyo Grande as
follows:
SECTlON 1. The word "person" as used herein shall include
the singular and the plural and shall also mean and include <~ perSon,
firm, corporation, association, club, copartnership, society, or any
other organization.
SECTION 2. No parson owning, or h.wing the care, custody,
possession or control of any radio receiving set, music box, player
piano, phonograph," or other ii:a.chine or device for the producing or
the reproduction of so~~d or for the intensification or amplification
of sound shall play, use, operate or perlliit to be played, used, or
operated such radio receiving set,rnusic box, player piano, phonograph
or other ';;achine or device in any restaurant, lunch counter, hotel

ess within the City of Arroyo Grande between the hours of twelve
o'clock midnight and seven o'clock A.M. the following morning.
SECTION .3. No person owning or having the care, custody,
possession or control of any radio receiving set, music box, player
piano, phonograph, or other ~achine or device for the producing or the
reproduction of ~~und, or for the intensification or amplification of

operated such radio receiving set, music box, player piano, phonograph,
or other machine or device in any restaurant, lunch counter, hotel
lobby, liquor establisru~ent, cocktail bar or any other place of
business within the City of Arroyo Grande in such manner that the
peace and good order of the neighborhood is disturbed or any person

owning, using or occupying property in the neighborhood are disturbed
or aIL."loyed.
The opera~ion of any such radio receiving set, music box,
player piano, phonograph, or other J;;achine or device in such manner
as to be plainly ~.udi ble at n distance of fifty (50) feet from the
building or structure in which it is located shall be prima facie
evidence of a violation of this ordinance.
SECTION 4. Any person violating any of the provisions of
this ordinance shall be deemed guilty of a misdemeanor, and upon
conviction thereof shall be punieh~ble by a fine of not more than I
Three Hundred Dollars ($300.00) or by imprisonment in the County Jail
of the County of San LuiS Obispo for not more than three (3) months,
or by both such fine and imprisonment.
SECTiON 5. This ordinance shall take effect and be in
full force and efl'"ct thirty de.ys ilf~er its final passage, and before
the expiration of fifteen days after its passage, it shall be published
wi th the n8.l:Jes of the ,,;embers voting for and against the same at
least once in the Arroyo Grande Herald Recorder, a newspaper of general
circulation, published and circulated in the said Cit,y of Arroyo
Grande.
