CREATING A FUND FOE CA?ITAL OUTLAYS FOR PUBLIC IMPHOVEMENTS. i

The City Council of the City of Arroyo Grande does ordain
f
as follows:
SECTION 1- A fund is hereby created for ca~ital outlays for

;JUblic improvecents under the provi!'\ions of that certain Act of i
the Legislature of tIle State of California entitled: "An Act to
provide for the levr and collection of taxes and assessments for
the ;:mrpose of creatin{~ a fund for capital outlays by cities,
counties, cities r..ud counties or districts," approved Jul)' 1, 1937,
and being Chapter 717 of the Statutes of 1937.
SECTION 2. Such fund shall be known as "Special Fund for
Capital Outlays" lInd it shall remain inviolate for tile making of
any capital outla)'s for public improvet!ents and no rIlOneys shall
be disbursed therefrom excepting for such a purpose, excepting
upon consent of the electors obt~lined as provided in said Act.
SECTION 3. Taxes may be levied u)on the taxable property
in snid City for the raisinG of moneys for said fund but no levy
so made shall exceed the liroi ta tion i1:1po sed b)7 th~, general laws,
of the State upon the right of said City to impose taxes, without
the assent of two-thirds (2/3) of the qualified electors of said
Ci t)' voting at any general or 9;:>8cial election [;,t \\llich such
proposition nay be submitted.
SECTION 4. The City Council may transfer to such fund any
unincumbered surplus funds remHining on hand in the City at the end
of any fiscal :year.
SECTION 5. All ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION 6. This Ordinance shall take effect thirty (30) days
after the date of its adoption and prior to the expiration of fifteen

in the ARROYO GRANDE HERALD-RECORDER, a.weekly ne~spaper, ,lUbl1shed and
circulated in the City of Arroyo Grande, and thenceforth and thereafter
the same shall be in full force and effect.
