3 AN OHDINANCE OF THE CITY OF ARROYO GRANDE, IN CALIFORJUA, PERTAININ
TO JUNK DEALERS, JUNK COLLECTORS, AND SECOND-HAND DEALERS, AS
4 HEREIN DEFIl'VED, PHOVIDING FOR THE LICElISING OF JUNK DEALERS,
JUNK COLLECTORS AND SECOND-HAND DEALERS, AND PRESCRIBING
6 PENALTIES FOR THB VIOLATION THEREOF.
6 The Council of the City of Arroyo Grande do ordain as follows:
7 Section 1. All persons, firms or corporations conducting the
8 business of buying or selling junk and second-hand goods in the
9 City of Arroyo Grande, shall pay a license fee of ~12.00 per year,
10 pa~rable each calendar quarter in advance.
11 Section 2. A junk dealer is defined to be any person having
12 a fixed place of business in the City of Arroyo Grande who engages
13 in buying or selling any old rags, sacks, arms, knives, tools or
14 implements of industry, papers, metal, old machinery, old automo-
16 biles or other articles commohly known as junk, and a junk collecto

16 is defined as a person not having any such place of business,

who goes from hotmeto house or place to place collecting, buying
18 or selling any of the above mentioned articles.
19 A second-hand dealer is defined to be any person, who buys
20 or sells used goods, wares or merchandise of every kind and
21 description.
22 Section 3. Every junk shop keeper and/or dealer, and every
23 second-hand dealer, shall keep a regular register showing the date
24 when, the names of all persons from.whom he purchases or trades for
25 any article or things whatsoever and the name and description of
26 such article or thing he purchased or traded for. He shall keep
27 a register showing the names of all persons to whom he shall sell
28 or trade any article or thing, and the name or description of such
29 article or thing so sold or traded and the date of such sale or
30 exchange. Such register shall at all times be open to the inspecti n

of any police officer. No junk shop keeper and/or dealer~ and no
32 second-hand dealer, shall purchase, trade for, or receive on any

1 pretext any article from any minor under the age of eighteen years
2 without the written consent of the parent or guardian of such
3 minor.
4 Section 4. 'All persons engaged solely in the business of
5 buying junk from licensed junk dealers, and used goods, wares
6 and merchandise from second-hand dealers for the purpose of
7 removing the same from the City of Arroyo Grande are hereby
8 exempted from the provisions of this ordinance.
9 Section 5. Any person who shall violate any of the provisions
10 of this ordinance shall be deemed guilty of a misdemeanor, and
11 upon conviction thereof shall be punishable by fine of not more
12 than $200.00 or by imprisonment in the County Jail for a period of
13 not more than ninety days, or by both such fine and imprisonment.
14 Section 6. All ordinances or parts of ordinances in conflict
15 herewith are hereby repealed.

17 and approval by the Mayor shall be published once in the Arroyo
18 Grande Herald-Recorder, a weekly newspaper of general circulation,
19 printed, published and circulated in said City.
