AN ORDINANCE PROHIBITING INTOXICATED PERSONS FROM BEING ON THE PUBLIC STREETS OR PUBLIC PLACES WITHIN THE CITY OF ARROYO GRANDE OR ON PRIVATE PREMISES TO THE ANNOYANCE OF OTHER PERSONS; PROVIDING PENALTIES FOR THE VIOLATION THEREOF; AND DECLARING SUCH ORDINANCE TO BE URGENT .ADD IMMEDIATELY NECESSARY. The City Council of the City of Arroyo Grande do ordain as follows: SECTION 1. No person shall, within the City of Arroyo Grande: First: Be drunk or intoxicated from the use of alcoholic liquor, on any public street or in any public place or I any place open to public view. Second: Be drunk or intoxicated from the use of alcoholic liquor, on any pr~vate premises or in any private home or other private building to the annoyance of any other person. Ii SECTION 2. Every person who shall violate any of the '\ provisions of this ordinance shall be guilty of a misdemeanor, I. I: and upon conviction thereof shall be punished by a fine not to /: exceed Two Hundred Dollars or by imprisonment in the County Jail ! of the County of San Luis Obispo not to exceed ninety days, or by both such fine and imprisonment. SECTION 3. All ordinances or parts of ordinances in \ \ conflict with this ordinance are hereby repealed. SECTION 4. This ordinance, 'after its passage and , , approval, shall be published once in the Arroyo Grande Herald- Recorder, a weekly newspaper printed, published and circulated in said City. SECTION 5, This ordinance is hereby declared to be urgent and immediately necessary to the preservation of the publiC . peace, health and safety and shall take effect and be in force from and after its passage. approval and publication. .._-~~ . , . .- , . .. , , The facts constituting such urgency are as follows: Of recent date large numbers of intoxicated persons have appeared on the streets of the City of Arroyo Grande and have caused disturbances and breaches of the peace. Suoh intoxicated persons have entered private premises and have disturbed the peace and quiet of other persons. This ordinance will provide a means by which such condition may be controlled and the peace and quiet. of the City maintained.
