RESOLUTION NO. 3 1 96 A RESOLUTION OF THE cItY COUNCIL OF THE CITY OF ARROYO GRANDE PROVIDING AN INTERPRETATION OF THE DEVELOPMENT CODE THAT A "QUICK LUBE" BUSINESS IS NOT A PERMITTED USE IN THE GENERAL COl\1MERCIAL DISTRICT .~ WHEREAS, the Development Code was adopted by the City Council on May 14, 1991, and became effective on June 13, 1991; and WHEREAS, Section 9-01.110 (G)(3) of the Development Code provides the Planning Commission with the authority to clarify ambiguities in the Title~ and WHEREAS, Development Code Table 9-07.030-A indicates businesses that fall within. the use category of "auto-related repair and service", which include automobile and' light truck repair, automobile service station, and tire sales and service, are not permitted in the General Commercial District; and WHEREAS, the Planning Commission has received a request for interpretation of whether a "quick lube" business that provides oil changes and replacement of small vehicle parts can operate in the General Commercial District; and WHEREAS, the Planning Commission, after due research and deliberation adopted Resolution No. 96-1590, November 19, 1996 providing the following: 1. The Arroyo Grande Development Code does not allow said use in the General Commercial District because the primary purpose of the General Commercial District is to provide for the general shopping. needs of area residents and workers with a variety of retaij and commercial services. Furthermore, auto-related repair and service is specifically limited to the Highway Commercial District in order to provide an area for auto-related uses along major travel routes. Therefore, the proposed use is not similar to other uses allowed in the General Commercial District. WHEREAS, the City Council has received an appeal of the Planning Commission interpretation; and WHEREAS, the City Council !1as considered the matter of the interpretation; and NOW, THIDUWORE, BE IT RESOLVED that the City Council of the City of Arroyo Grande hereby makes the interpretation that the business described above is NOT a permitted use in the General Commercial District.
