AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF ARROYO GRANDE AMENDING CHAPTER 7 OF TITLE
6 OF THE MUNICIPAL CODE REGARDING DELINQUENT
BILLS; DISCONTINUANCE OF SERVICE; TURN-OFF AND
TURN-ON CHARGES.
WHEREAS, City of Arroyo Grande, County of San Luis Obispo, State 9f California
("City") is duly authorized and existing under the laws' of said State; and
WHEREAS, The City of Arroyo Grande performs certain services relating to .utility
billing that benefit specific individuals and businesses; and
WHEREAS, such services are to be paid by those parties who receive such services;
NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of Arroyo
Grande, as follows:
Section 1. Arroyo Grande Municipal Code Section 6-7.04 is amended in its
entirety as follows:
Section 6-7.04. DelinQuent Bills: Discontinuance of Services: Turn-off and Tum-
on CharQes.
All meters shall be read by the Water Department as provided in section 6-7.07
of this chapter, and all bills for water or service shall be due and payable at the City
Hall upon presentation. All water bills remaining unpaid for a period of thirty (30) days
shall thereupon become past-due. Where water bills so become past-due, notification
will be delivered of such status and a late fee levied. All water bills remaining unpaid
for a period of forty-one (41) days since issuance shall become delinquent. Where
water bills so become delinquent, service may be shut off at any time after a ten (10)
day written notice; and such accounts shall be subject to the water turn-off and turn-on
charge provided 'for in this section. The Director of Financial Services, at hislher
discretion, may cause a meter reading to be made at any time; and thereupon the bill
for water used since the previous reading shall become immediately due and payable
and shall become past-due on the thirtieth (30th) day following the mailing or
presentation of such bill; and such accounts shall be subject to the late fee charge,
water turn-off and turn-on charge provided for in this section.
The water late-fee, turn-off and turn-on charge shall be as determined by
Council resolution.
. Section 2: If any section, subsection, subdivision, paragraph, sentence, clause
or phrase of this Ordinance or any part thereof is for any . reason held to be
unconstitutional, such decision shall not affect the validity of the remaining portion of
this Ordinance or any part thereof. The City Council hereby declares that it would have
passed each section, subsection, subdivision, paragraph, sentence, clause or phrase

thereof, irrespective of the fact that anyone or more section, subsection, subdivision,
paragraph, sentence, clause or phrases be declared unconstitutional.
Section 3: Within fifteen (15) days after passage of this Ordinance, it shall be
published, together with the names of the Council members voting thereon, in a
newspaper of general circulation within the City.
Section 4: This Ordinance shall take effect thirty (30) days after its adoption.
On motion of Council Member Fuller , seconded by Council Member Lady
and on the following roll call vote, to wit:
AYES: Council Members Fuller, Lady, Tolley, and Mayor Dougall
NOES: None
ABSENT: Council Member Runels
The foregoing Ordinance was passed and adopted this 9th day of December 1997.
