AN ORDINANCE OF THE CITY OF ARROYO GRANDE CITY COUNCil ESTABLISHING COMPENSATION FOR COUNCil MEMBERS IN ACCORDANCE WITH STATE LAW THE CITY COUNCil OF THE CITY OF ARROYO GRANDE DOES ORDAIN AS FOllOWS: Section 1. Effective December 1, 1998, Arroyo Grande Municipal Code Section 2-1.201 is repealed in its entirety and replaced to read, in full, as follows: "2-1.201 Salary Compensation for Council Members (a) Population. As of January 1, 1998, the estimated population of the City of Arroyo Grande is less than 35,000 residents. (b) Council Salaries. The salary for the Mayor and for each City Council Member shall be $330 per month. (c) Council Expenses. The salaries set forth herein are, and shall be, exclusive of any amount payable to each member of the Council for actual and necessary expenses incurred by the Council Member in the performance of official duties for the City. (d) RetiremenUBenefits. Any amounts paid by the City for retirement, health and welfare, and federal social security benefits shall not be included for purposes of determining salary under this section, provided the same benefits are available and paid by the City for its employees. generally. If any section, subsection, subdivision, paragraph, sentence, clause, or phrase of this Ordinance or any part thereof is for any reason held to be unconstitutional, such decision shall not affect the validity of the remaining portion of this Ordinance or any part thereof. The City Council hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause or phrase thereof, irrespective of the fact that anyone or more section, subsection, subdivision, paragr~ph, sentence, clause, or phrase be declared unconstitutional. Section 3. This Ordinance shall be in full force and effect thirty (30) days after its passage; and within fifteen (15) days after its passage, it, shall be published once, together with the names of Council Members voting thereon, in a newspaper- of general circulation within the City. t .. ~ '> ORDINANCE NO. 491 C.S.
