O 481 C.S. . . . .-. . , " . , ~ '} . -, ., " - . -1 ORDINANCE NO. 481 C.S. .J AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE AMENDING PORTIONS OF l THE ARROYO GRANDE MUNICIPAL CODE TO RESTRUCTURE CERTAIN CITY COMMISSIONS, BOARDS AND COMMITI'EES J THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE DOES ORDAIN AS FOLLOWS: SECTION 1: Arroyo Grande Municipal Code Section 3-5.09 is hereby amended to read in its entirety as follows: Sec. 3-5.09. Downtown Parking Advisory Board. (a) For the purpose of advising the Council and making recommenda- tions as to how the revenue derived from the additional levy of license taxes imposed by this chapter shall be used within the scope of the purposes set forth in Section 3-5.08 of this chapter, and to have and perform such other powers and duties as the Council may determine, there shall be created a Downtown Parking Advisory Board consisting of five (5) members to be appointed by the Council and ,. --1 to serve at its pleasure and without compensation, such members to be persons who ~ have businesses within the II Area" and pay an additional levy of license taxes as provided for by this chapter. Appointments for the Board and the filling of vacancies shall be made in the manner provided by resolution of the Council. Vacancies shall be filled for unexpired terms only. The Council may annually approve a budget to include an estimate of the expenditures to be made to carry out the purposes of the II Area. " (b) The Members of the Downtown parking Advisory Board shall serve for a term as specified by resolution of the Council. SECTION 2: Arroyo Grande Municipal Code Section 4-3.21 (a) and (b) are hereby' amended to read in their entirety as follows: Sec. 4-3.21. Traffic Commission. J (a) Created: Membership and Tenns of Office. There is hereby created a Traffic Commission which shall consist of five (5) members who shall serve for a term as specified by resolution of the City J Council. .4 , , 481 .c~s~ . (b) Tenn~ of Office: Appointments and Vacancies. [ Appointments for the Traffic Commission and the filling of vacancies shall be made in the manner provided by resolution of the Council. Vacancies shall be filled for unexpired terms only. All Traffic Commission Members shall serve at [ the pleasure of the Council. SECTION 3: Arroyo Grande Municipal Code Section 9-01.110 A., B. and C. are hereby amended to read in their entirety as follows: Section 9-01.110 Planning Commis..~ion A. Planning Commission - Created A Planning Commission in and for the City is hereby established and created, pursuant to the provisions of Sections 65000 through 65906 of the Government Code, as now or hereafter amended. B. Membership The Planning Commission is hereby recreated and re-established, and shall continuously succeed the Commission previously existing under the provisions of ,,'- this Section heretofore existing, except as modified by the provisions of this ~ Section. The Commission shall consist of five (5) members, who shall be qualified L electors of the City, but who shall not otherwise be officials of the City. The Mayor and each respective member of the Council shall appoint a representative to the Planning Commission subject to approval by a majority of the Council. All Commission members shall serve at the pleasure of the Council. C. Tenns of Office Members of the Planning Commission shall serve a term ending the January 31 st following expiration of the term of the respective appointing Mayor or Council Member. Members of the Planning Commission may be removed by a majority vote of the Council. Terms for all current Planning Commission Members shall end on March 31, 1997. SECTION 4: Arroyo Grande Municipal Code Sections 10-1.01, 10-1.02, 10-1.03 and lO- t 1.04 are hereby amended to read in their entirety as follows: Sec. 10-1.01. Members of the Senior Advisory Commission shall be qualified electors of the City and shall serve without compensation. Members of the Senior Advisory Commission shall hold no other public office in the City. Sec. 10-5.03. Senior Advisory Commis..c;ion Members: Tenns of Office. J Members of the Senior Advisory Commission shall be appointed to serve for a term as specified by resolution of the City Council. Sec. 10-5.04. Senior Advisory Commission: AppointmenLe; and Vacancies. J Appointments for the Commission and the filling of vacancies shall be made in the manner provided by resolution of the Council.. Arroyo Grande Municipal Code Sections 10-6.03 and 10-6.04 are hereby [ amended to read in their entirety as follows: Sec. 10-6.03. Teen Advisory Committee Members: Tenns of Office. Members of the Teen Advisory Committee shall be appointed to serve for [ a term as specified by resolution of the City Council. Sec. 10-6.04. Teen Advisory Committee: Appointments and Vacancies. Appointments to the Teen Advisory Committee and the filling of vacancies shall be made in the manner provided by resolution of the Council. Vacancies shall be filled for the unexpired terms only. All members shall serve at the pleasure of the Council. SECTION 7: If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this Ordinance or any part thereof is for any reason held to be unconstitutional, such decision shall not affect the validity of the remaining portion of this Ordinance or any part thereof. The City Council hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause or phrase thereof, irrespective of the fact that anyone or more section, subsection, subdivision, paragraph, sentence, clause or phrases be declared unconstitu- tional. ~~ SECTION 8: A summary of this Ordinance shall be published in a newspaper published \.. and circulated in the City of Arroyo Grande at least five (5) days prior to the City Council meeting at which the proposed Ordinance is to be adopted. A certified copy of the full text of the proposed Ordinance shall be posted in the office of the City Clerk.. Within fifteen (15) days after adoption of the Ordinance, the summary with the names of those City Council members voting for and against the Ordinance shall be published again, and the City Clerk shall post a certified copy of the full text of such adopted Ordinance. SECTION 9: This Ordinance shall take effect thirty (30) days after its adoption.
