RESOLUTION NO., 3478
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ARROYO GRANDE ACCEPTING A GRANT OF OPEN
SPACE EASEMENT, PORTIONS OF LOTS 37, 38, 39 &
40, TRACT 2265
WHEREAS, an open space agreement has been provided as required to satisfy the
conditions of approval for Tract 2265; and
v
WHEREAS, the open space agreement includes a grant of open space easement to the
City of Arroyo Grande over portions of Tract 2265; and
WHEREAS, the City desires, and considers it to be in the public interest that such areas
be maintained in permanent open space; and
WHEREAS, after due study and deliberation, the City Council finds as follows:
1. That the preservation of the subject land as open space is consistent with the
General Plan; and
2. That the preservation of the subject land as open space is in the best interests of
the City because the land, if retained in its natural state, has scenic value to the
public, is valuable as wildlife habitat, and will help preserve the rural character of
the City.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Arroyo
Grande does hereby approve the Open Space Agreement Granting an Open Space
Easement to the City of Arroyo Grande, portion of lots 37, 38, 39, & 40, Tract 2265, and
authorizes the Mayor to execute the Agreement.
On motion of Council Member Dickens, seconded by Council Member Runels, and on
the following roll call vote, to wit:
AYES: Council Members Dickens, Runels, Ferrara, and Mayor Lady
NOES: None
ABSENT: Council Member Tolley
