R 3857 RESOLUTION NO. 3857 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE APPROVING TEMPORARY USE PERMIT NO. 05-011 (4th OF JULY VILLAGE CELEBRATION) AUTHORIZING THE USE OF CITY PROPERTY, CLOSURE OF A CITY STREET, WAIVING OF PERMIT FEES AND ADDING THE CELEBRATION TO THE LIST OF EVENTS THAT ARE GRANTED A WAIVER OF PERMIT APPLICATION FEES WHEREAS, organizers of the 4th of July Village Celebration have requested .closure of Short Street and the use of City property as outlined below, for its annual 4th of July Village Celebration to be held on July 4, 2005; and WHEREAS, organizers of the 4th of July Village Celebration have requested that the City waive permit fees; and WHEREAS, the 4th of July Village Celebration benefits the community in general by celebrating Independence Day; NOW, THEREFORE,BE IT RESOLVED that the City Council of the City of Arroyo Grande hereby approves Temporary Use PenT-lit No. 05-011 as set forth below, subject to the conditions as set forth in Exhibit "An, attached hereto and incorporated herein by this reference: \ 1. Short Street shall be closed and the gazebo at Olohan Alley be utilized for a 4th of July Village Celebration between 11 :00 am and 2:30 pm on July 4, 2005; and 2. That fees associated with Temporary Use Permit 05-011 be waived; and 3. That the 4th of July Village Celebration be added to the list of events that are granted a waiver of permit fees. I ---..- -"--------._._--- RESOLUTION NO. 3857 PAGE 3 EXHIBIT "A" CONDITIONS OF APPROVAL "4th OF JULY VILLAGE CELEBRATION" TEMPORARY USE PERMIT 05-011 MONDAY, JULY 4, 2005 GENERAL CONDITIONS: 1. The applicant shall ascertain and comply with all State, County and City requirements as are applicable to this project. 2. The event shall occur in substantial conformance with the application and plans on file in the Community Development Department. 3. The applicant shall agree to defend at his/her sole expense any action brought against the City, its agents, officers, O/' employees because of the issuance of said approval, or in the alternative, to relinquish such approval. The applicant shall reimburse the City, its agents, officers, or employees, for any court costs and attorneys' fees which the City, its agents, officers or employees may be required by a court to pay as a result of such action. The City may, at its sole discretion, participate at its own expense in the defense of any sUj;h action but such participation shall not relieve applicant of hislher obligations under this condition. PARKS AND RECREATION CONDITIONS: i 4. The Village Improvement Association shall inform the Parks and Recreation Director as to how many trashcans are neeqed at least one (1) week prior to the event. 5. The applicant shall provide needed trash bags. 6. No parking of vehicles on green space. ." ADDITIONAL CONDITIONS 7.
