Minutes 1995-07-11 ., ~ MINUTES REGULAR MEETING OF THE CITY COUNCIL TUESDAY, JULY 11, 1995 CI~Y COUNCIL CHAMBERS, 215 EAST BRANCH STREET ARROYO GRANDE, CALIFORNIA The City Council of the City of Arroyo Grande met at 7(30 p.m., with Mayor A. K. "Pete" Dougall presiding. 1. AND 2. FLAG SALUTE AND INVOCATION Charles Howell, Post Commander, Five-cities Veterans of Foreign Wars, Post and Auxiliary 2829, led the Pledge of Allegiance to our Flag, and Mayor Dougall presented a letter of thanks to Mr. Howell. The Rev. Paul Jones delivered the , , invocation. 3. ROLL CALL Present with Mayor Dougall were council Members Drew Brandy, Michael Fuller, Michael Lady and James Souza. Staff members present were city Manager Robert Hunt, city Attorney Roger Lyon, city Clerk Nancy Davis, Chief of Police Rick TerBorch and Public Works Director John Wallace. 4. ORAL COMMUNICATIONS None. 5. CONSENT AGENDA It was moved by Souza/Brandy, and the motion passed unanimously to approve Consent Agenda Items 5.a. through 5. g. , with the recommended courses of action. 5.a. June 27, 1995, city council Minutes. Approved. 5.b. June, 1995, Investment Report. Received and Filed. 5.c. Second Quarter, 1995, Sales Tax Revenue Report. Received and Filed. 5.d. Resolution No. 3083 Requesting Authorization to Close a Street for the Harvest Festival Parade; Saturday, September 30, 1995. Approved with correction of date from September 29 to September 30, 1995. 5.e. Telecommunications Reform, HR 1555 (Bliley); Request to Submit Letter to Andrea Seastrand, Member of Congress, Asking for the Reinstatement of Local control in the Pending Legislation Before the House of Representatives. Approved. 5.f. Award of Bid; Arroyo Grande Creek Clearing; Eman Court. Approved awarding to low bidder. 5.g. Improvements to Traffic Way and Grand Avenue in conjunction - CITY COUNCIL MINUTES JULY 11, 1995 with Current Caltrans Contract. Approved. 6. REGISTER OF CHECKS It was moved by Brandy/Souza, and the motion passed unanimously to approve Cash Disbursements in the amount of $391,907.58, as listed in the July 6, 1995, staff report of Finance Director David Bacon. 7.A. PUBLIC HEARING - OUESTION OF THE ABATEMENT AND REMOVAL OF ABANDONED. WRECKED. DISMANTLED OR INOPERATIVE VEHICLES. AND/OR PARTS THEREOF: 420 GREENWOOD DRIVE: JULI~ PEFFLY Chief TerBorch referred to his staff report and gave , background on this matter. He said on May 2, 1995, neighbors , I made a complaint about two inoperable and unsightly vehicles in ! j the driveway at 420 Greenwood. He said as of July 6, 1995, one iJ of the vehicles had been removed, but the other was still at the :. location. He said Mrs. Julia Peffly, resident at 420 Greenwood, had requested a hearing before the City Council. He said the Council's alternatives were, (1) Uphold the action of the Chief of Police to have the vehicle abated, or (2) Overrule the action of the Chief of Police to abate the vehicle. After being assured that the hearing had been duly published and all legal requirements met, Mayor Dougall declared the hearing open and said all persons would be heard regarding the matter. MS. JULIA PEFFLY and her son, BYRON PEFFLY, spoke to the Council. They said the vehicle in the driveway was a classic Ford Mustang that has been in the restoration process for four or five years. They showed a magazine photograph of a similar car that took the owner 10 years to restore. They said neighbors have boats and other vehicles parked in their yards. Mr. Peffly said he did not have a job and could not afford parts for the Mustang. Mrs. Peffly said they would be willing to cover the vehicle. Council Members discussed the matter with the Pefflys, and said that the family had not been singled out by the city. They said that a citizen had complained about the vehicles and the possible ordinance violation had to be investigated by the city. The city Manager said under the ordinance the Council has wide latitude in sOlving the problem. Chief TerBorch said the covering of the vehicle would meet the intent of the ordinance and the Police Department would oversee this compromise with the neighbors. MARIE CATTOIR of 195 Orchid Lane said she hoped the City would pursue any apparent difficulty in the neighborhood that ~ CITY COUNCIL MINUTES JULY 11, 1995 underlies this problem of inoperative vehicles. She said she hoped that City actions did not make the situation worse and the young man disillusioned and cynical. 8.A. RESOLUTION REQUESTING AUTHORIZATION TO CLOSE VARIOUS CITY STREETS FOR THE ARROYO VALLEY CUSTOM CAR SHOW: SATURDAY. JULY 29. 1995 It was moved by Souza/Lady (5-0-0, Souza, Lady, Brandy, Fuller and Dougall voting aye) to approve Resolution No. 3084 Requesting Authorization to Close Various Streets for the Arroyo Valley Custom Car Show. 8.B. ESTABLISHMENT OF 1995-96 FISCAL BUDGET STUDY SESSIONS Council Members agreed to hold the 1995-96 Fiscal Year Budget Study Sessions on Wednesdays, August 2 and 16, 1995, at 7:00 p.m. in the city Council Chambers, 215 East Branch Street. 9. WRITTEN COMMUNICATIONS Mayor Dougall read a letter from the President of the International Institute of Municipal Clerks announcing the acceptance of the Arroyo Grande City Clerk into the IIMC Academy for Advanced Education. 10. ORAL COMMUNICATIONS Mayor Dougall said he and the city Manager had contacted potential developers of commercial land in the Rancho Grande subdivision to say the City is still interested in cooperating on the development of the property. Mayor Dougall said people have commented to him that the City is very receptive in its dealings concerning building and developing property. He said city staff apparently is doing the right thing. 11. CLOSED SESSION The Council adjourned at 8:07 p.m. to a Closed Session on the following: (a) Conference with Legal Council on Anticipated Litigation; Government Code Section 54956.9(b): significant Exposure to Litigation Involving Two (2) Potential Cases. 12.
