R 3322 ,~... . ., ~_ CQ}D q '--(j " RESOLUTION NO. 3322 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE AMENDING THE GENERAL PLAN LAND USE ELEMENT AND THE GENERAL PLAN MAP; GENERAL PLAN AMENDMENT 97-002 (APPLICANT: CHARLES BAKER) WHEREAS, the City of Arroyo Grande General Plan Map indicates that the area .generally located south of Grand Avenue, north of Ash Street, east of Oak Park Blvd., and west of Spruce Street requires adoption of a specific plan prior to development; and WHEREAS, the City of Arroyo Grande General Plan Land Use Element Policies 1.5, 2.1.j. and 2.2.g. indicate that the area generally located south of Grand Avenue, north of Ash Street, east of Oak Park Blvd., and west of Spruce Street requires adoption of a specific plan prior to development; and WHEREAS, the applicant, Charles Baker, has submitted an application to amend the General Plan and Development Code, and adopt the Berry Gardens Specific Plan for the area described above; and WHEREAS, the Berry Gardens Specific Plan would establish land use, development and design standards for the above described area; and WHEREAS, on August 25, 1998 the City Council certified an Environmental Impact Report prepared for the Berry Gardens Specific Plan; and WHEREAS, the Planning Commission of the City of Arroyo Grande has reviewed General Plan Amendment 97-002 at duly noticed public hearings on August 4, 1998 in accordance with the Development Code of the City of Arroyo Grande at which time all interested persons were given the opportunity to be heard; and WHEREAS, the City Council of the City of Arroyo Grande has considered General Plan Amendment 97-002 at duly noticed public hearings on August 25, and September 8, 1998 in accordance with the Development Code of the City of Arroyo Grande. at which time all interested persons were given the opportunity to be heard; and WHEREAS, the City Council has reviewed and considered the information and public testimony presented at the public hearings, staff reports, and all other information and documents that are part of the public record; and WHEREAS, the City Council finds, after due study, deliberation and public hearing, the . following circumstances exist: < , Resolution No.3322 General Plan Amendment 97-002 Page 2 of 4 1. The proposed General Plan Amendment is consistent with the goals, objectives, policies, and programs of the General Plan and will not result in any internal inconsistencies within the General Plan. Based on the information contained in the staff report and accompanying materials, the amendment to the General Plan Map is consistent with the text of the General Plan. '2. The Proposed General Plan Amendment will not adversely affect the public health, safety, and welfare. The street improvements, installation of public utilities, sewage lift station, and drainage basin proposed as part of the Specific Plan would mitigate any potential adverse impacts to the public, health, safety, and welfare. 3. . The potential environmental impacts of the proposed General Plan Amendment are insignificant or can be mitigated to a less than significant level as identified in the Berry Gardens Specific Plan Environmental Impact Report. 4. The Berry Gardens Specific Plan area is no longer economically viable for agricultural production because annual revenues from agricultural production are less than annual expenses of property taxes and equipment.maintenance. Further, the close proximity of residents requires the application of safer, but less effective pesticides, thus increasing costs. Additional expenses are also incurred for because additional labor, irrigation, and fertilizers are required to combat the problems inherent in the site's weak, sandy soil. NOW. THEREFORE. BE IT RESOLVED that the City Council of the City of Arroyo Grande, California hereby approves amendments to the General Plan land Use Element and General Plan map as follows: Section 1: Land Use Element Policies 1.5 and 2.1.j. are hereby deleted in their entirety. Section 2: land Use Element Policy 2.2.g. is hereby deleted in its entirety and replaced with the following: Adopt the Berry Gardens Specific Plan for the area generally located south of Grand Avenue, north of Ash Street, east of Oak Park Blvd., and west of Spruce Street and maintain a maximum density of 4.8 dwelling units per acre within Subarea 1 of the Specific Plan. Section 3: The General Plan Map is hereby amended as shown in the attached Exhibit "A", which is incorporated herein by this reference. Resolution No. 3322 General Plan Amendment 97-002 Page 3 of 4 Section 4: This Resolution shall become effective when Ordinance No. 499 c.s. (Development Code Amendment 97-007) becomes effective.
