Minutes 1980-07-22 -,JTO City Council Arroyo Grande, California July 22, 1980 The C~ty Council met in regular sess~on with Mayor Pope presiding. Counc11 Members B'Ann Smith, Karl A. Hogan, and Lawrence Upon roll call, E. Vandeveer reported present. Council Member Mark M. Millis was absent. PLEDGE OF ALLEGIANCE AND INVOCATION Council Member Vandeveer led the Mayor Pope delivered the invocation. Pledge of Allegiance to our Flag. Thereafter, APPROVAL OF MINUTES ,On motion of Council Member Smith, seconded by Council Member Vandeveer and unan1mously voted, the minutes of July 8, 1980 were approved as prepared. ~ APPROVAL OF WARRANTS On motion of Council Member Smith, seconded by Council Member Vandeveer and unanimously carried, Demand Warrants No. P0896 through P0909 and No. 13274 through 13377 in the amount of $169,322.41; and Payroll Warrants No. 17530 through 17666 in the amount of $59,762.38 were approved and ordered paid. After discussion and upon motion by Council Member,Vandeveer, seco~ded by Council Member:Hogan, it was unanimously voted to 1nstruct the env1ronmental coordinator toireview the negative impact report on this property and report at the next meeting. RESOLUTION OF NECESSITY RELATING TO THE CITY WATER STORAGE FACILITY, ACCESS AND EASEMENTS City Engineer Karp stated that a court order to permit su:veying of the necessary properties has been received and sent to the respect1ve property owner. A resolution may be provided at the next meeting and no a~tion is re,quired at this time. !' PROGRESS REPORTS - VARIOUS CITY PROJECTS COMMUNITY BUILDING - Upon motion of Council Member Vandeveer, seconded by Council Member. Hogan, it was voted unanimously to approve the second progress payment in th~ amount of $26,455.97. SOTO SPORTS COMPLEX - City Engineer Karp reviewed the recommendation of the architect with reference to the tennis court ,bids. The architect recommends :) awarding the bid to California Sports Construction in the amount of $145,350.00. Upon motion b~ Council Member Vandeveer, seconded by Council Member. Hogan, it was voted unanimously to accept the architect's recommendation and award the bid to California Sports Construction in the amount of $145,350.00 REPORT AND RECOMMENDATION OF PARKS The repo~t was received. AND RECREATION COMMISSION MEETING OF JULY 9, 1980 .1 RESOLUTION ESTABLISHING A FOUR-WAY STOP AT BRISCO ROAD AND LINDA DRIVE City Eng{neer Karp. stated that as.a.part of the opening of Linda Drive. and. Bennett Avenue, Council recommended a four-way. stop at Brisco and Linda Drive. This has been reviewed by the Parking and Traffic Commission and they have recommended adoption. Upon motion by Council Member Smith, seconded by Council Member Vandeveer, it was voted unanimously to dispense with reading the balance of this resolution. AN ORDINANCE OF THE CITY OF ARROYO GRANDE DELETING THE TITLE AND CONTENTS OF CHAPTER 8 OF TITLE 8 OF THE ARROYO GRANDE MUNICIPAL CODE AND DESIGNATING SAID CHAPTER OF TITLE 8 AS: CHAPTER 8 DEMOLITION PERMITS REQUEST FOR EXTENSION AND/OR SUBMIT HOUSING ELEMENT UPDATE TO STATE DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT Jeanie Barrett, attorney for California Rural Legal Assistance, stated that before monies are available from the state for housing, the cities must have their Housing Elements up to date. It is her opinion that the City of Arroyo Grande is in violation by not having the Housing Element approved and she requests that it either be submitted to the state for approval or obtain an extension. Planning Director Castro stated he does not interpret the Code to say it is mandatory that the Housing Element be approved by the state. It was the consensus of the ~o Council that no action be 'taken on this request. ACCEPT GRANT DEED FOR RIGHT OF WAY ON BENNETT AVENUE FORM'ARROYO GRANDE DISTRICT CEMETERY City Engineer Karp explained that the deed is required to provideca right of way to make the physical connection of street construction northerly of Mid State Bank. Upon motion of Council Member Vandeveer, seconded by Council Member Hogan, it was voted unanimously to accept the grant deed for the right of way. GRANT SLOPE EASEMENT TO MILT HAYES, PLATINO AND ORO DRIVE City Engineer Karp explained that this easement is requested to allow for landscaping. Upon motion of Council Member Vandeveer, seconded by Council Member Hogan, it was voted unanimously to grant the slope easement to Milt Hayes for landscaping purposes. u WRITTEN COMMUNICATIONS Mayor Pope stated a letter was received from the Arroyo Grande Community Hospital nurses inviting the public to a meeting Thursday, July 24, 1980 at 7:30 P.M. at Fair Oaks and Valley Road. He also acknowledged receipt of a letter from the City of San Luis Obispo concerning a rate study for cable c television.
