Minutes 1977-05-24CITY COUNCIL ARROYO GRANDE, CALIFORNIA MAY 24, 1977 The City Council met in regular session with Mayor Pro Tem Mark Millis presiding. Upon roll call, Council Members Al Spierling, Matthew Gallagher, Jr., and Calvin Schlegel reported present. Mayor de Leon is absent. PLEDGE OF ALLEGIANCE AND INVOCATION Mayor Pro Tem Millis led the Pledge of Allegiance to our Flag; and immediately thereafter, Councilman Schlegel delivered the invocation. APPROVAL OF MINUTES On motion of Councilman Spierling, seconded by Councilman Gallagher and unanimously carried, the minutes for the regular meeting of May 9, 1977 and regular adjourned meeting of May 17, 1977, were. approved as prepared. _, 333 MAY 24, 1977 CITY COUNCIL PAGE 2 ARROYO GRANDE, CALIFORNIA APPROVAL OF WARRANTS On motion of Councilman Schlegel, seconded by Councilman Spierling and unanimously carried, Payroll Warrants No. 8794 through No. 8891, in the total amount of $31,102.66, were approved and ordered paid. No General Warrants were submitted for approval. REPORT RE. RECENT YOUTH IN GOVERNMENT DAY - THURMAN Gloria Thurman, the student "Mayor Pro Tem" at the May 17th Youth in Government Day activities held in the City, was present and reported briefly on the events of the day and thanked the Council and City Staff for the opportunity afforded students by the involvement of students in local government for that day. REQUEST FOR FUNDS FROM S L 0. COUNTY SYMPHONY_ASSOCIATION - DENIED The Council read a letter from the San Luis Obispo County Symphony Association, Yequesting support from the City in the amount of $1,000 or $500. The Council discussed the matter, generally agreeing with Councilman Spierling that funds be given only to organizations providing for people's needs such as Meals on Wheels, etc. Agreement was also indicated with Mayor Pro Tem Millis' feeling that social welfare is a county function and therefore should be supported from county funds. APPROVE REQUESTS OF A G HARVEST FESTIVAL COMMITTEE: 9/29 THRU 10/2/77 The Council read a letter from Jim Scrivani, President of the Arroyo Grande Valley Gay Nineties Harvest Festival Committee, infonning~the Council that the 40th Annual Festival, with the theme of "Fortieth Harvest Hey-Dey", will be held September 29th through October 2nd, 1977, He requested approval by the Council of certain festivai related aspects. Mr. Scrivani was present and clarified that it is hoped the City will pick up costs for any extra barricades it needs to rent for traffic control, as the Committee is not a profit making venture and a $200+ billing is difficult to meet. He further clarified that the parade route will be the same as in past years, along Grand and Branch into the Village area. After Council discussion, a motion was made by Councilman Spierling, seconded by Councilman Schlegel and unanimously carried, approving use of the City's public parking lots, south of Branch Street, for the Harvest Festival booth area; authorizing the staff to work with Mr. Scrivani regarding the supplying of barricades for traffic controls; and authorizing that a letter be submitted to the California Department of Transportation, requesting closure of a portion of Highway 227 (Branch Street) from Highway 101 to Mason Street, during the morning of October 1st for the parade. Mr. Scrivani was commended for his work on the Harvest Festival and his timely requests in preparation for the activities. GRANT FEE EXEMPT BUSINESS LICENSE TO RAINBOW GIRLS ASSEMBLY #100 A motion was made by Councilman Schlegel, seconded by Councilman Spierling and unanimously carried, granting a fee exempt Business License to the International Order of The Rainbow for Girls, Arroyo Grande Assembly No. 100, for the sale of fireworks, from noon on June 28, 1.977 through midnight on July 6, 1977, at 1650 Grand Avenue, as requested by Ruth. Ann Hall, Worthy Associate Advisor, They have obtained a State Fireworks Retail License and approval from Fire Chief Marsalek. COUNCILMAN SCHLEGEL EXCUSED HIMSELF DUE TO A POSSIBLE CONFLICT OF INTEREST AND IS NOW ABSENT. ~ I APPROVE USE PERMIT APPLICATION WAIVER EXCEPT PUBLICATION COSTS - LARRABEE BROS. ' The Council reviewed a letter from Larrabee Brothers Distributing Company, distributors for Coors Beer, requesting that the Use Permit Application Fee of $50.00 be waived for the Recycling Center they are proposing for 8 hours a week at the Sunset Furniture Store ~3arking lot (Brisco & Grand Ave'..). A memorandum from Planning Director Gallop was reviewed, which indicated a public hearing on the Use Permit Application will be held June 7, 1977, with costs of the legal publication for said hearing to be considered. Administrator Butch displayed a rough diagram indicating where the collection truck for aluminum cans will be located. The Council generally favored the limited recycling operation, providing proper policing is done and good housekeeping procedures are practiced. After j Council discussion,, a motion was made by Councilman Spierling, seconded by Council- man Gallagher and unanimously carried, granting a waiver to Larrabee Bros. Distributing Company of the Use Permit Application Fee, except for the-newspaper legal publication costs noticing the public hearing, which costs will be deducted from the $50.00 fee already paid and the balance will be reimbursed to Larrabee Brothers. COUNCILMAN SCHLEGEL IS NOW PRESENT. 334 CITY~COUNCIL MAY 24, 1977 ARROYO GRANDE, CALIFORNIA PAGE 3 APPROVE FIVE-YEAR RENEWAL OF BRUSH POPPER RIDING CLUB LEASE FOR CITY'S MESA PROP. The Council read a letter from the Brush Poppers Riding Club, requesting to renew their lease with the City for the Mesa property off of Highway 1, for an additional 5-year period. They don't anticipate any change in their horse show and gymkhana 'activities. After Council discussion, a motion was made by Councilman Spierling, seconded by Councilman Gallagher and unanimously carried, approving the renewal, for an additional five-year period, of a lease between the City and the Brush Poppers Riding Club, for City-owned property on "the mesa" off of Highway 1, to be used for the Club:'s horse shows and gymkhanas. GRANT FEE EXEMPT BUSINESS LICENSE TO F VE CITIES JAYC A motion was made by Councilman Schlegel, seconded by Councilman Gallagher and unanimously carried, granting a fee exempt Business License to the Five Cities Jaycees for the sale of fireworks from June 30, 1977 through July 4', 1977, at the Williams Bros. Market parking lot, as requested by Bob Williams, Project Chairman for the Jaycees. They have obtained a State Fireworks Retail License and approval from Fire Chief Marsalek. MUNI. CODE AMEND. - ORDINANCE AMEND.- OFF-STREET PARKING REQUIREMENTS - 1ST READING City Attorney Shipsey read, for its first reading, the title of an ordinance amending the Municipal Code by making certain amendments to the Zoning Ordinance regarding minimum off-street parking requirements; thereafter, a motion was made by Councilman Schlegel, seconded by Councilman Gallagher and unanimously carried, to dispense with reading the balance of this ordinance, MUNI.- CODE AMEND'. - ORDINANCE AMENDING SUBDIVISION ORDINANCE - FIRST READING City Attorney Shipsey reviewed an Ordinance he had prepared pursuant to the Council's direction, making certain amendments to the Subdivision Ordinance. The Council had held a public hearing and study session on the matter.. City Engineer Karp suggested that a small discrepancy in the proposed amendments be removed, which came to light this afternoon when he reviewed a Subdivision Improvement Plan. He recommended that Section 9-3.502(h)(7)(i) regarding minimum dimensions for cul de sacs stay as is; that the proposed (h)(7)(ii) be renumbered to (iii); and the following be inserted for (ii): "a 46 foot minimum radius to the curb line; and...". This will allow for a 40' turn-around for firetrucks; a 6' parking lane and 6' sidewalk. The Council agreed with the recommended change and requested that it be incorporated into the Proposed Ordinance for adoption. After Council discussion, City Attorney Shipsey read the title of an ordinance, for its first reading, amending the City's Subdivision Ordinance; thereafter, a motion was made by Councilman Schlegel, seconded by Councilman Spierling and unanimously carried, to dispense with reading the balance of this ordinance. PUBLIC HEARING - CREATION OF "PF" AND "-SF" FLOOD PLAIN DISTRICTS The Council reviewed a memorandum from Planning Director Gallop, stating that the Planning Commission has recommended that the "S-F" Secondary Flood Plain District be a combining district, and the ordinance creating a Primary Flood Plain be adopted as originally proposed. The Council also reviewed a letter from the Department of Army, Corps of Engineers, informing them that the flood plain information study by them has been canceled in lieu of a proposed flood insurance study sponsored by the Federal Insurance Administration. This study will cover the same areas as the Flood Plain Information Study and additionally include streams within the City. It is anticipated that the flood insurance study will be completed within the next two years and completion of the project study will be after that. Upon being assured by the City Clerk that all requirements as provided by law, regarding notification of hearing, have been complied with, Mayor Pro Tem Millis declared the hearing open and all persons would now be heard regarding these proposed Flood Plain District provisions. There being no public discussion on this matter, Mayor Pro Tem Millis declared the hearing closed. The Council discussed the proposed ordinance, generally agreeing that its provisions would be adequate until the reports and maps are received from the Corps of Engineers. ORDINANCE NO. 155 C.S. AN ORDINANCE OF THE CITY OF ARROYO GRANDE AMENDING THE ARROYO GRANDE MUNICIPAL CODE BY AMENDING SECTION ' 1, CHAPTER 2, OF TITLE 1 TO PROVIDE FOR INFRACTIONS. Several complaints were voiced by residents about dogs allowed to run at large in the early morning hours and that there does not appear to be any control of this by the Department of Animal Regulation. Said complaints will be relayed to said Department by City Staff. AMEND MUNI. CODE - VARIOUS AMENDMENTS TO ZONING ORDINANCE - FIRST READING i . iI ~ ~.. City Attorney Shipsey read, for its first reading, the title of an ordinance amending the Municipal Code by making certain changes to the City's Zoning Ordinance; thereafter, a motion was made by Councilman Sohlegel, seconded by Councilman Gallagher and unanimously carried, to dispense with reading the balance of this ordinance, REVIEW LATEST LEGISLATIVE BULLETINS FROM LEAGUE OF CALIFORNIA CITIES The Council received and reviewed the latest Legislative Bulletins from ' the League of California Cities. After Council discussion, City Administrator Butch was directed to reaffirm the Council's opposition to SB 164, "Compulsory & Binding Arbitration" with the City's legislative representatives; and write to the same legislators stating this City's concerns regarding possible costs to the City of SB 650 "Litter Control. Recycling and Resource Recovery". The Council also read a letter from City Attorney Shipsey, prompted by a claim filed against the City by persons involved in a dune buggy accident in the Pismo State Beach area dunes. He urged that legislation be requested to protect governmental agencies from claims such as these where there is no basis for liability, as handling said claims by the insurance company, even though there is no involvement, , does cost the City. After Council discussion, the City Administrator was directed ' to write to Assemblywoman Hallett and the Chairman of the Channel Counties Division of the League of California Cities, urging the passage of legislation to prevent these "nuisance lawsuits" against cities. ass CITY COUNCIL ARROYO GRANDE, CALIFORNIA MAY 24, 1977 PAGE 5 APPOINTMENT OF REPRESENTATIVES TO COMMISSION VACANCIES - HELD OVER Further discussion regarding appointment of representatives to fill vacancies on the Planning and Parks & Recreation Commissions was held over until Mayor de Leon returns. APPROVE CONCEPT OF JOINT POWERS AGREEMENT RE SELF-INSURANCE Administrator Butch reported on a recent meeting re, Worker's Compensa- tion Self-insurance, attended by representatives from all the cities in the Ccunty. A proposed'Joint Powers Agreement Establishing the Central" Coast Self Insurance Fund" had been reviewed and revised, Initial payments into the fund would be the same amount paid by each City into the State Workmen's Compensation Fund during the 1.976-77 fiscal year, with adjustments to be made thereafter, according to a formula set forth in the Agreement. Re-insurance would also be obtained. separate from. the self-insurance, to cover any losses between $100,000 and $3 million. One city, probably San Luis Obispo, will handle the financial aspects of the self-insurance initially. If several cities decide to withdraw from the joint powers self-insurance at a later date, the cities can always go back to State Compensation, which cannot deny coverage. R. L. Kautz & Co., who has been workigg with the cities on the proposed self-insurance, will provide people to work with cities on a safety program. After Council discussion, a motion was made by Councilman Spierling, seconded by Councilman Schlegel and unanimously carried, directing the City Attorney to study the proposed Joint Powers Agreement Establishing the Central Coast Self Insurance Fund, with the object of the City participating in said self insurance program. REPORT - PROGRESS ON COUNTY REGIONAL CENTER - SPIERLING Councilman Spierling reported that the recent meetings regarding the South County Government Center related to general concepts, an outline and site map which were included in the Council Members' agenda packets. He pointed out that the buildings will be situated at angles on the property to take advantage of solar heat to get deep sun penetration and wide overhangs provide protection in the summer. The concept is to bury the buildings into the hillside to have them blend in rather than dominate the hillside. The map also includes a proposed concept for an Agricultural Museum. RECEIPT OF REVISED BUDGET FROM HUMAN RELATIONS COMMISSION FOR 1977-78 - APPROVED The Council reviewed a report from the Human Relations Commission of South San^Luis Obispo County, indicating they have reviewed their budget and are only requesting a contribution of $400.00 from the City instead of the $550 requested last year. After Council discussion, a motion was made by Councilman Spierling, seconded by Councilman Gallagher and unanimously carried, approving the amount of $400.00 be budgeted as this City's share of the Human Relations Commission's 1977-78 operating budget. NOTICE RE. DISSOLUTION OF COASTAL VALLEY PLANNING COUNCIL The Council read a letter from John Wells, Chairman of the Coastal Valley Planning Council, advising that said Planning Council has decided to dissolve its organization.- It was requested that the City Council adopt a resolution dissolving said organization, per the by-laws. The Council directed City Attorney Shipley to prepare such a resolution. DENY CLAIMS AGAINST CITY BY M. WALTER: HOWART & VELASOUEZ As recommended by the City's insurance carrier, a motion was made by Councilman Gallagher, seconded by Councilman Schlegel and unanimously carried, denying claims against the City by Mary Walter; and Jose D. Velasquez & Sandra K. Howarth, the latter two involving a dune buggy accident in the Pismo State Beach Park area. APPROVE CETA~WORK SITE PROGRAM AGREEMENT Administrator Butch reported that because of federal extensions of Title VI projects and activities, the CETA Office has requested the City approve a revised work-site agreement for its public service projects, particularly regarding Strother Park. APPROVAL OF CITY'S APPLICATION FOR CETA HELP ON STROTHER PARK _ The Council read a letter from the County Administrative Office, infozming them that the City's application has been approved for use of CETA employees to aid in the preparation of Strother Community Park. ACCEPT RESIGNATION OF HUMAN RELATIONS COMMISSIONER - DAMS A motion was made by Councilman Spierling, seconded by Councilman Gallagher and unanimously carried, accepting with regret the resignation of Nancy A. Davis as the City's representative on the South County Human Relations Commission, effective immediately as per her request; and directing that a letter and Certifi- cate of Appreciation be presented to Mrs. Davis in thanks for her oustanding work on said Commission since 1973. APPOINT REPRESENTATIVES & ALTERNATES TO TRANSPORTATION TECH. ADVISORY COMMITTEE The Council read a letter from Al Spierling, President of the Area Council of Governments, requesting that the City nominate two voting representatives and alternates to the Transportation Technical Advisory Committee. After Council discussion, a motion was made by Councilman Schlegel, seconded by Councilman Gallagher and unanimously carried, appointing Planning Director Bob Gallop and City Engineer Paul Karp to the Transportation Technical Advisory Committee; and Planning Assistant Tom Sullivan and Director of Public Works Joe Anderson, Jr., as their alternates. UPDATE RE. MOSQUITO ABATEMENT IN SOUTH COUNTY The Council read a letter from the County Department of Public Health, advising that their investigation of complaints r8ceived regarding a mosquito situation in the Pismo Slough has determined there is no health hazard; no nuisance exists; and therefore control of the mosquito population is not warranted at this time. RECEIPT OF BIDS FOR REMOVAL OF HOUSE ON "ANDERSON" PROPERTY - HELD OVER Administrator Butch requested,. and the Council agreed, to hold over the matter of bids for removal of a house located on the "Anderson" property, located south of Branch Street. between Short and Bridge Streets, where the continuation of public parking is planned. DISCUSSION RE. CO.-CITIES REGIONAL ELD_E_RLYLHANDICAPPED TRANSPORTATION PROPOSAL Councilman Spierling reported that he had just received'an update on the County and Cities Regional Elderly/Handicapped Basic Transportation Network proposal, and therefore requested this item be held over until copies can be given them for review. NOTICE RE. PUBLIC HEARING SET FOR SPREADING ASSMTS. ON DEL SOL IMPROVEMENTS: 6/14 The Council was informed that a public hearing. has been set for 8:00 P.M. on June 1'4, 1977 to consider the Superintendent of Streets' report regarding spreading of assessments for the concrete improvements installed on Del Sol Street. I REPORT - RECENT ZONE 3~ADVISORY COMMITTEE MEETING - KARP City Engineer Karp reported on the May 19, 1977 meeting of the Zone 3 Advisory Committee, at which the regular monthly reports from Parks & Beaches and ~ the Water Treatment Plant had been heard. As of May 1, 1977, Lopez Dam was 14.97 feet below the spillway. The City of Arroyo Grande has almost 1,000 acre feet ~ ~ left in its entitlement. Discussion was also held regarding a letter from the Bureau of Land Management, stating that there are oil and gas leases up for study "" in preparation for Negative Zmpact Report. One site is in the Lopez water shed, ~ just north of Lopez Road. Zone 3 is sending a letter to 'said Bureau, protesting the leasing and subsequent drilling. APPROVE ANNUAL TRANSPORTATION CLAIM FOR SB 325 FUNDS & RE-AMENDED CLAIM FOR 76-77 The Council reviewed a report from City Engineer Karp, regarding filing of the City's annual Transportation Claimfor 1977-78 and a re-amended Claim for 1976-77, for the City's SB 325 funds. The re-amended claim for 1976-77 deletes the claimed amounts for transit systems as they are not funded yet and this will be reapplied for when said funds are necessary for transportation needs. Council- man Spierling recommended. that a finding be incorporated into the resolutions submitting the aforesaid claims, to protect the City's SB 325 funding, as follows: "...that, there are no unmet transit needs that cannot reasonably be met with existing and proposed transit plans that are currently available." The Council concurred with this inclusion. RESOLUTION NO. 1282 A RESOLUTION OF THE CITY COUNCIL OF THECITY OF ARROYO GRANDE APPROVING THE ANNUAL TRANSPORTATION CLAIM AND AUTHORIZING ITS SUBMITTAL TO THE SAN LUIS OBISPO COUNTY AND CITIES AREA PLANNING COORDINATING COUNCIL. AUTHORIZE FINAL PROGRESS PAYMENT, PROD. #90-76-2, DEL SOL IMPROVEMENTS (HERMRECK) City Engineer Karp reviewed with the Council his report regarding Project No. 90-76-2, involving concrete improvements on Del Sol Street done by M. J. Hermreck, Inc. He recommended acceptance of the improvements and approval for the final progress payment. After Council discussion, a motion was made by Councilman Schlegel, seconded by Councilman Spierling and unanimously carried, accepting the concrete improvements on Del Sol Street as completed by M: J. Hermreck, Inc., authorizing a progress payment to said contractor in the amount of $12,381.53; authorizing the Mayor to sign the Notice of Completion and directing the City Clerk to record same; and authorizing City Staff to release to said contractor the final 1A8 retention 35 days after the date of recordation of said Notice of Completion. SET PUBLIC HEARING RE. COUNTY-WIDE SOLID WASTE MANAGEMENT PLAN: 6/14/77, 8 P.M. Administrator Butch informed the Council that the Planning Commission will be holding a public hearing on June 7th to consider the County-Wide Solid Waste Management Plan, and the Council could consider the matter at its June 14, 1977 meeting. After Council discussion, a motion was made by Councilman Spierling, seconded by Councilman Gallagher and unanimously carried, setting a public fiearing at 8:00 P.M. on June 14, 1977 to consider the County-Wide Solid Waste Management Plan. PROGRESS REPORT - SOUTH SAN LUIS OBISPO COUNTY SANITATION DYSTRICT The Council reviewed the monthly report for April, 1977, from Chief Plant Operator Rhoades, regarding maintenance and operation of the South San Luis Obispo County Sanitation District's Treatment Plant. The District's Administrator, Tom Butch, reported that correspondence has been received from Pismo Beach and the State Water Resources Board to discuss the possibility of the City of Pismo Beach tying into the District's outfall line. 339 CITY COUNCIL MAY 24, 1977 ARROYO GRANDE ,. A motion was made by Councilman Spierling, seconded by Councilman Schlegel and unanimously carried, setting a public hearing on June 14, 1977 at 8:00 P.M. to consider the Federal Revenue Sharing funds as reflected in the~City's Preliminary 1977-78 Municipal Budget. SET TOWN MEETING RE. FUTURE DIRECTION OF CITY: MAY 31, 1977, 7:30-9:30 P.M. Councilman Spierling distributed copies of a prepared statement and recommendation for the setting of a series of town meetings at which the Council Members will receive public input regarding policies for the City, which reflect the wishes of the people. He also recommended a study committee be formed to prepare a policy to preserve the farmland, which will be agreeable to all persons concerned. He recommended the following for membership on said committee: D.G. Porter, Don Talley, Doug Hitchen, Al Spierling and Ken Levine, DVM. He further recommended that Legislators Hallett and Nimmo be involved by urging legislation making any policy and/or ordinance derived from studies to be,enforceable for proper assessment of any land affected. The Council discussed the proposal at length, generally agreeing with the concept, but recamnending the forums be broadened to receive all concerns of the citizens and that emphasis be placed on what direction the people want this City to take for the future, not a general gripe session of past mistakes. After further Council discussion, it was generally agreed that the first Town Forum would be set for Tuesday, May 31, 1977, to be held from 7:30 P.M. to 9:30 P.M. at the Arroyo Grande High School on Valley Road, and a second Forum be set for June 8, 1977 at one of the other area schools, with further Forums set as necessary, and the staff to look into availability of facilities for said hieetings. On motion of Councilman Schlegel, seconded by Councilman Spierling and unanimously carried, the meeting adjourned at 9:40 P.M. to the Arroyo Grande Valley High School on Tuesday, May 31, 1977 at 7:30 P.M. for a Town Forum.
