SUBJECT: ACCEPTING RESULTS OF OFFICIAL CANVASS OF ALL
VOTES CAST - NOVEMBER 7, 2000 CONSOLIDATED
GENERAL ELECTION - CITY OF ARROYO GRANDE

RECOMMENDATION:
It is recommended that the City Council adopt the attached Resolution accepting
the Certificates of the County Clerk certifying the results of the, canvass of all
votes cast November 7, 2000 at the Consolidated General Municipal Election,
City of Arroyo Grande.
FUNDING:
The pas'sage of Measure R-2000, increasing the City's Transient Occupancy Tax
rate from 6% to 10%, will result in an increase to City revenues.
DISCUSSION:
On November 7, 2000 a General Election was held in the County of San Luis
Obispo. Consolidated into that election was the Arroyo Grande Municipal
Election, for the purpose of electing one (1) Mayor, two (2) City Council
Members, one (1) City Clerk, one (1) City Treasurer, and voting on one (1) ballot
measure ("Measure R-2000") concerning an increase in the City's Transient
Occupancy Tax ("hotel/motel bed tax") rate from 6% to 1 0%.
Total voter registration for the City of Arroyo Grande was 10,507. The number of
total ballots cast was 8,393 for a 79.88% voter turnout.
Measure R-2000 passed by 63.21 %. A copy of the full text of Measure R-2000 is
included in the attached Ordinance, which shall go into effect ten days after
adoption of the Resolution certifying the results of the Election. The effective
date of the Transient Occupancy Tax rate increase shall commence on January
1 , 2001.

The County Clerk has conducted the official canvass of the returns of the votes
cast in the election and has certified the results. Adoption of the attached
Resolution will accept the County Clerk's Certificate of the official election results.

The following alternatives are provided for the Council's consideration:
- Approve staffs recommendations;
- Do not approve staffs recommendations; or
- Provide direction to staff.

RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ARROYO ACCEPTING THE CERTIFICATES OF THE
COUNTY CLERK - RESULTS OF CANVASS OF ALL
VOTES CAST AT THE GENERAL ELECTION HELD
NOVEMBER 7,2000 IN THE CITY OF ARROYO GRANDE
WHEREAS, on November 7,2000, a General Election was held in the County of San
Luis Obispo and the City of Arroyo Grande; and,
WHEREAS, included on the ballot for said General Election was a listing of candidates
for one (1) Mayor, two (2) Members of the City Council, one (1) City Clerk, one (1) City
Treasurer, and one ballot measure ("Measure R-2000") for the City of Arroyo Grande in
its scheduled General Municipal Election; and,
WHEREAS, the San Luis Obispo County Clerk canvassed the returns of the votes cast
at said General Election held on November 7,2000, and has certified the results; a copy
of which is attached and incorporated herein as Exhibit A.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Arroyo
Grande does hereby accept the Certificates of the County Clerk- Results of Canvass of
All Votes Cast in the City's General Municipal Election appearing on the November 7,
2000 General Election Ballot (Exhibit "A").
BE IT FURTHER RESOLVED that the City Clerk shall immediately make and deliver to
each of the persons so elected a Certificate of Election signed by the City Clerk and
authenticated; that the City Clerk shall administer to each person elected the Oath of
Office prescribed in the Constitution of the State of California and shall have them
subscribe to it and file it in the Administrative Services Department. Each and all of the
persons so elected shall then be inducted into the respective office to which they have
been elected.
BE IT FURTHER RESOLVED that the City Clerk shall certify to the passage and
adoption of this Resolution and enter it into the book of original resolutions.

AN ORDINANCE OF THE CITY OF ARROYO
GRANDE AMENDING SECTION 3-3.303 OF THE
ARROYO GRANDE MUNICIPAL CODE RELATING
TO TRANSIENT OCCUPANCY TAX RATES
The People of the City of Arroyo Grande do hereby ordain as follows: '
Section 1. Purpose
It is the intent of this ordinance to increase funds in order to offset revenue losses
due to State budget cut-backs.
Section 2. Type of Tax
A Transient Occupancy Tax is a General Tax as defined in Government Code
Section 53721. The tax is imposed for General Governmental Purposes.
Section 3. Transient Occupancy Tax
Section 3-3.303 of the Arroyo Grande Municipal Code is hereby amended to read
as follows:
For the privilege of occupancy in any hotel, each transient shall
be subject to and shall pay a tax in the amount of ten percent
(10%) of the rent charged by the operator. Such tax shall
constitute a debt owed by the transient to the City, which debt
shall be extinguished only by payment to the operator or to the
City. The Transient shall pay the tax to. the operator of the hotel
at the time the rent is paid. If the rent is paid in installments, a
proportionate share of the tax shall be paid with each installment.
The unpaid tax shall be due upon the transient's ceasing to
occupy space in the hotel. If for any reason the tax due is not
paid to the operator of the hotel, the Financial Services Director
may require that such tax be paid directly to the Financial
Services Director.
Section 4. Effective Date of Tax Increase
The tax rate authorized by this ordinance shall commence on January 1, 2001.

Section 5. Authority to Adopt Measure
This ordinance and the tax authority herein is enacted pursuant to the provisions
of Section 7280 of the California Revenue and Taxation Code, and in compliance
with the California Constitution Article XIII A, Section 4 and Article 3.7 of Chapter
4 of Part 1, of Division 2 of Title 5 of the California Government Code
commencing with Section 53720.
Section 6. Severabilitv
If any section, subsection, sentence, phrase or clause of this ordinance is for any
reason held to be unlawful, such decision shall not affect the validity of the
remaining portion of this ordinance or any part thereof. The people of Arroyo
Grande hereby declare that they have adopted the ordinance and each section,
subsection, sentence, phrase or clause thereof, irrespective of the fact that any
one or more section, subsection, sentence, phrase or clause be declared
unlawful.
Section 7. Effective Date of Ordinance
This ordinance shall go into effect ten days after adoption, pursuant to Elections
Code Section 9217.
