Minutes 1992-11-24 s,. . 55 MINUTES REGULAR MEETING OF THE CITY COUNCIL TUESDAY, NOVEMBER 24, 1992 CITY COUNCIL CHAMBERS, 215 EAST BRANCH STREET " ARROYO GRANDE, CALIFORNIA The City Council of the City of Arroyo Grande met at 7: 30 P.M., with Mayor Mark M. Millis presiding. 1. and 2. FLAG SALUTE AND INVOCATION Mayor Millis led the Pledge of Allegiance to our Flag, and the Rev. Phil Coleman of Oak Park Foursquare Church delivered the invocation. 3. ROLL CALL Present were Mayor Millis and Council Members A. K. "Pete" Dougall, M. P. .Pete" Gallagher, Gene Moots and B'Ann Smith. Staff Members present were City Manager Chris Christiansen, City Attorney '-- Judy Skousen, City Clerk Nancy Davis, Planning Director Doreen Liberto-Blanck, Parks and Recreation Director John Keisler and Chief of Police Rick TerBorch. 4. ORAL COMMUNICATIONS SARAH MAY, 425 South Elm street, volunteer for the Central Coast Animal Protection Society, requested that the City allocate funds in this fiscal year for the Department of Animal Regulation Spay and Neuter Program. She said the County's cat POPulation is out of control, and the problem is compounded when the City does not fund the program for a year. 5.CONSENT AGENDA It was moved by Dougall/Smith, and the motion passed, with Council Member Moots abstaining on the vote on the City Council Minutes, to approve Consent Agenda Items 5.A. through 5.H., with the recommended courses of action. 5.A. October 27, 1992, City Council Minutes. Approved. 5.B. November 4, 1992, Senior Advisory Commission Minutes. Information. S.C. Letter of Resignation from Gee Gee Soto, Parks and Recreation Commissioner. Accepted with regrets. 5.D. Letter of Resignation from Phil Romero, Senior Advisory commissioner. Acceptance of parcel Map AG 89-423: Arroyo Grande Community Hospi tal. Accepted. 6. PRESENTATION OF PLAOUES OF APPRECIATION TO GEE GEE SOTO. FORMER '-., PARKS ANQ RECREATION COMMISSIONER. AND PHIL ROMERO. FORMER SENIOR ADVISORY COMMISSIONER Mayor Millis said the name Gee Gee Soto is synonymous with Parks and Recreation. He said the presentation of a plaque to Gee Gee Soto was an entirely inadequate honor for someone who had been involved with all parks and recreation in the City for many years. He said she served 14 years on the commission and worked on the Kiwanis, Strother and Rancho Grande parks. He said she was the driving force behind the Soto Sports Complex. -~.. ,.. - -. . 1 -'. CITY COUNCIL MINUTES NOVEMBER 24, 1992 Mayor Millis presented the plaque to Phil Romero, and thanked him for his three years of service on the Senior Advisory Commission. 7.REGISTER OF CHECKS It was moved by Dougall/Gallagher, and the motion passed unanimously, to approve cash disbursements in the amount of $674,887.93, as listed in the November 5, 1992, Staff Report of Finance Director David Bacon. 8.A. SETTING PUBLIC HEARING DATE AND TIME FOR RANCHO GRANDE PARK EXPANDED INITIAL STUDY AND MITIGATED NEGATIVE DECLARATION " Mr. Christiansen said at a previous meeting the City Council set November 24, 1992, as a date to consider the public hearing date regarding Rancho Grande Park. He recommended that since a new counc~l will be constituted on December 1, 1992, that the present Council continue this item to its regular meeting of December 8, 1992, when a hearing date can be selected. The Council voted to continue this agenda item to December 8, 1992, on the unanimously approved motion of smith/Gallagher. 8.B. SECOND READING OF ORDINANCE ADOPTING A NEGATIVE DECLARATION~ AMENDING CHAPTER 9 OF THE MUNICIPAL CODE (AMENDMENT TO THE DEVELOPMENT CODE) AND INSTRUCTING THE CITY CT.RRK TO FILE A NOTICE OF DETERMINATION (REZONE CASE NO. 92-225} It was moved by Smith/Gallagher (4-0-1, Smith, Gallagher, Dougall and Millis voting aye, Moots abstaining) to adopt Ordinance No. 453 C.S. Amending Chapter 9 of the Municipal Code (Amendment to the Development Code) and Instructing the city Clerk to File a Notice of Determination (Rezone Case No. 92-225). 9.A. APPOINTMENT OF TRACY THOMAS TO THE PARKS AND RECREATION COMMISSION: TERM EXPIRES JUNE 30. 1993 (REPLACING GEE GEE SOTO WHO RESIGNED} Mayor Millis nominated Tracy Thomas to the Parks and Recreation commission, succeeding Gee Gee Soto. The Council approved. Ms. Thomas' term will expire June 30, 1993. 9.B. APPOINTMENT OF MARJORY CASH TO THE MOBILE HOME RENT REVIEW BOARD: TERM EXPIRES JUNE 30. 1995 Mayor Millis nominated Marjory Cash to the Mobile Home Rent Review Board. The Council approved. Ms. Cash's term expires June 30, 1995. 9.C. REOUEST OF BOB KNOTTS (BOB'S AUTO REPAIR. 414 TRAFFIC WAY}. FOR DISCUSSION REGARDING ALARM FEES Mr. Christiansen said Mr. Knotts is concerned about the way the City implements the fees in the false alarm ordinance that went into effect about a year and a half ago. He said since April, ,'"' 1992, Bob's Auto Repair has had seven false alarms that Arroyo Grande Police responded to. He said the ordinance states that on the first three alarms there is no charge. He said then a warning letter is sent saying that penalties will incur on the next false alarm and the alarm system should be checked. He said once an alarm owner has four or more false alarms within a 12-month period, penalties are $25 for the fourth false alarm: $50 for the fifth, and $100 for six and above. He said Mr. Knotts objected to the philosophy of 12 months having to pass before a previously fined alarm owner is fine free. He said since the ordinance was enacted, there.has been a 23 percent reduction in false alarm calls. BOB KNOTTS, 414 Traffic Way, said he should be charged only the actual cost for the police to come out on a false alarm call. He said he was penalized four and one-half times that. 2 '.' ~ 57 " CITY COUNCIL MINUTES NOVEMBER 24, 1992 Chief of Police Rick TerBorch said other cities have higher fees than Arroyo Grande, and if the City went to a cost-for-service charge, the fees would be higher than they are now. He said usually alarm systems are shut down until they are fixed, and usually it is found that the alarms are faulty or there is neglect in handling the alarms. He said only 29 out of 415 sites with alarms have gone beyond three calls in 12 months. He said Mr. Knotts' charges totaled $475 'for nine false alarm calls by the police. council Members discussed the matter and said perhaps there should be some flexibility in the ordinance or an appeal process built in to it. It was moved by Smi thjMoots, and the motion passed unanimously to send the request of Mr. Knotts back to staff look into the possibility of adding an appeal process to the false alarm ordinance and return to the Council for approval. 9.D. SURPLUS POLICE DEPARTMENT PROPERTY It was moved by smith/Gallagher (5-0-0, Smith, Gallagher, Moots, Dougall and Millis voting aye) to approve Resolution No. 2956 Declaring Surplus Police Property and Donating 33 Bicycles to the "Santa Cop" Christmas Program. 9.E. DESIGNATION OP LANDMARK TREES, NO. 91-62 AND NO. 91-63 Mr. Christiansen said these resolutions were to correct resolutions passed previously on said Landmark Trees so that their San Luis Obispo County Assessor's Parcel Numbers would be included. It was moved by Smith/Gallagher (5-0-0, Smith, Gallagher, Dougall, Moots and Millis voting aye) to approve Resolution No. 2957 Designating Landmark Tree 91-62. It was moved by smith/Gallagher (5-0-0, Smith, Gallagher I Moots, Dougall and Millis voting aye) to approve Resolution No. 2958 Designating Landmark Tree 91-63. 9. F. AGREEMENT BE'l'WEJ;:N THE COUNTY OF SAN LUIS OBISPO AND THE CITY OF ARROYO GRANDE REGARDING THE "FIVE ACRES" OF PROPERTY LOCATED BETWEEN THE SOUTH SAN LUIS OBISPO COUNTY REGIONAL CENTER AND THE ARROY$> GRANDE COMMUNITY CENTER Mr. Christiansen said the agreement between San Luis Obispo County and the city regarding the "five acres" on land between the South County Regional Center and the City's Community Center provides that the 10-year improvement requirement by the City will be eliminated; that quasi-public uses such as a IIY" or Boys and Girls Clubs will be acceptable with the approval of the County Board of Supervisors and that other municipal purposes will require no approval by the Board, that the county will be granted a lot split on the property with one side of the land being used for county facilities and the other side being designated for single falllily homes. ~ Mayor Millis thanked Fourth District Supervisor Ruth Brackett for all the work she has done in bringing this matter to completion. He said she has been working on it for more than two years. He said first she saw to it that the City qot the five acres, and now has been working with County and City officials to take away sOllie of the restrictions on the Use of the property. SUPERVISOR BRACKETT said that as soon as the City approves the agreement, it will be on the Consent Agenda of the Board of 'supervisor.li. She".said all that would be left to do would be the C!ty's lot line adjustlllent and rezoning of the property. 3 58. . . CITY COUNCIL MEETING NOV~MBER 24, 1992 Mayor Millis said the relationship the city has with Supervisor Brackett is the best the city has ever had with a supervisor. ~upervisor BracKett said already she is in discussion with Mayor-Elect Gallagher on water issues that affect the ~ounty and the city. It was moved by smith/Gallagher, and the motion passed unanimously to adopt the agreement with the county of San Luis Obispo, as written. --.. 9.G. ENTRANCE AND BUSINESS SIGNS. GRAND AVENU~ AND U.s. 101. AND REOUEST TO CAUTRANS FOR SUCH The Planning commission and the Architectural Advisory cOlMlittee have requested that the City support a request to Caltrans to erect business identification signs with one facing north and one facing south at the Grand Avenue/U.S.I01 offramps indicating the Village commercial area and listing the various businesses. He said the businesses would pay for the signs. It was moved by HootS/Dougall, and the motion passed unanimously to authorize the Mayor to sign a letter requesting caltrans to install business identification signs along the highway, including "Historic village" sign, and authorize planning staff to bring back a report discussing the feasibility of a City entrance sign(s) identifying businesses near the Grand Avenue offramp. 10. WRITTEN COMMUNICATIONS council Member Gallagher referred to a November 23, 1992, memorandum from Planning Director Doreen Liberto-Blanck stating that the Council of Governments had officially approved the city's two Proposition 116 projects. The memorandum said the City would be receiving approximately $430,000 in grant money to install bicycle/pedestrian paths. The Planning Director also wrote that the Arroyo Grande High SChool/Margaret Harloe project also will be sent to the State for a Statewide competition for grant funds. She wrote that in addition, a proposal for a separate bicycle/pedestrian bridge across Highway 101 at Fair Oaks Avenue also will be sent to the State for funding (this is funding in addition to the $430,000). council Member Gallagher said the City is well on its way to creating some nice bicycle/pedestrian traffic lanes with the cOlMlunity. 11. ORAL COMMUNICATIONS Council Member Smith asked if the improvement project at U.S. Highway 101 and Oak Park Boulevard was on running on schedule, and Staff answered in the affirmative. Council Member Dougall said that Caltrans is planning to ~ overlay the street from the Highway 101 overpass to the Village entrance. supervisor Brackett said there will be countywide bicycle committee to coordinate activities. She said each supervisor will be appointing two members to the committee, and invited Arroyo Grande applicants. council Member Dougall thanked the city for its four years of confidence, the Staff for its support, the newspapers for their quotes and his wife, who was his best critio. 12.
