A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ARROYO GRANDE ACCEPTING EASEMENTS AND
PUBLIC IMPROVEMENTS FOR CONDITIONAL USE
PERMIT NO. 04 -009 HAMPTON INN LOCATED AT 1400
WEST BRANCH STREET
WHEREAS, the City Council approved Conditional Use Permit No. 04 -009 on July 26
2005, and a Final Parcel Map on May 27, 2008 and amended the conditions of the
Conditional Use Permit on May 12, 2009; and
WHEREAS, the project was conditioned to offer a dedication of easements and to
construct certain public improvements; and
WHEREAS, the developer has offered the easements and constructed the
improvements required by the conditions of approval for Conditional Use Permit No. 04-
009; and
WHEREAS, staff has inspected the improvements and finds they are constructed in
accordance with the approved plans for the project; and
WHEREAS, the developer has provided the 10% warranty security as required by the
conditions of approval, to be released at the conclusion of the one -year warranty period,
provided the improvements are still in satisfactory condition.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Arroyo
Grande does hereby accept the following for Conditional Use Permit No. 04 -009 and
Parcel Map AG 06 -0204:
1. Offer to Dedicate a Public Water Main easement
2. Street tree planting and maintenance easement on Parcel Map AG 06 -0204.
3. Public Utility easement on Parcel map 06 -0204.
4. Curb, Gutter and Sidewalk installation.
5. Water Services and Devices installation.
On motion of Council Member Guthrie, seconded by Council Member Brown, and on
the following roll call vote, to wit:
AYES: Council Members Guthrie, Brown, Costello, Ray and Mayor Ferrara
NOES: None
ABSENT: None
the foregoing Resolution was passed and adopted this 9 day of August 2011.
