A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ARROYO GRANDE ACCEPTING EASEMENTS AND
IMPROVEMENTS FOR CONDITIONAL USE PERMIT NO.
06-003 PAD I OF THE FIVE CITIES CENTER
WHEREAS, the City Council approved Conditional Use Permit (CUP) No. 96-541 to
construct the Five Cities Center in July 1996, which included the construction of
fourteen (14) commercial buildings in two phases; and
WHEREAS, the City Council approved Amended Conditional Use Permit No. 06-003 on
July 24, 2007 to amend Conditional Use Permit No. 96-541 to allow construction of three
(3) commercial buildings (Buildings 1-1, 1-2 and 1-3) within the Five Cities Center ("project");
and
WHEREAS, the project was conditioned to offer a dedication of easements to the public
and to construct certain public improvements; and
WHEREAS, the developer has offered the easements and constructed the
improvements required by the conditions of approval for Conditional Use Permit No. 06-
003; and
WHEREAS, staff has inspected the improvements and finds they are constructed in
accordance with the approved plans for the project; and
WHEREAS, the developer has provided the 10% warranty security as required by the
conditions of approval, to be released at the conclusion of the one-year warranty period,
provided the improvements are still in satisfactory condition.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Arroyo
Grande does hereby accept the following for Conditional Use Permit No. 06-003:
1. Offers to dedicate two Public Waterline Easements on Parcel 1 of Parcel Map
AGAL 95-133.
2. Public Water mains and devices installed on Parcel 1 of Parcel Map AGAL 95-
133.
On motion of Council Member Costello, seconded by Council Member Ray, and by the
following roll call vote, to wit:
AYES: Council Members Costello, Ray, Brown, and Mayor Ferrara
NOES: None
ABSENT: Council Member Guthrie
the foregoing Resolution was passed and adopted this 27`h day of September 2011.
