RESOLUTION NO.3186
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE
AUTHORIZING ACCESS TO DEPARTMENT OF JUSTICE
CRIMINAL HISTORY INFORMATION FOR EMPLOYMENT PURPOSES
WHEREAS, Penal Code Sections 111 05(bH1 0) and 13300(b)(10) authorize cities,
counties, and districts to access state and local summary criminal history information
for employment, licensing, or certification purposes; and
WHEREAS, Penal Code Sections 111 05(bH1 0) and 13300(bH 10) require that there be
a requirement or exclusion from employment, licensing, or .certification based on
specific criminal conduct on the part of the subject of the record; and
WHEREAS, Penal Code Sections 11105(bH10) and 13300(b)(10) require the City
Council to specifically authorize access to summary criminal history information for
employment, licensing and/or certification purposes.
NOW, THEREFORE, BE IT RESOLVED THAT THE CITY OF ARROYO GRANDE is
hereby authorized to access summary criminal history information for employment,
licensing, or certification purposes; and
BE IT FURTHER RESOLVED, that the City shall not consider a person who has been
convicted of a felony or misdemeanor involving moral turpitude eligible for employment
or licensing; except that such conviction may be disregard.ed if it is determined that
mitigating circumstances exist, or that the conviction .is not related to the employment
or license in question.
On motion of Council Member Iady , seconded by Council Member Souza ,
and on the following roll call vote, to wit:
AYES: Council Members Lady, Souz~, Brandy, Fuller, and Mayor Dougall
