R 3147 RESOLUTION NO. 3147 A RESOLUTION OF THE CITY OF ARROYO GRANDE IN SUPPORT OF AB 2342 MARINE WEATHER INFORMATION, FORECASTS, OR ADVISORIES WHEREAS, the Morro Bay Commercial Fisherman's Organization donated a weather warning flag pole system for the North T-Pier in Morro Bay in memory of fellow commercial fisherman, Al French, who lost his life at the Morro Bay harbor entrance; and WHEREAS, the weather warning system is a public service for the boating public, the community, and visitors to Morro Bay; and - WHEREAS, the Morro Bay City Council unanimously approved the weather warning flag pole system; and WHEREAS, the Harbor Department of the City of Morro Bay listens to the National Weather Service Marine forecast and raises the appropriate flag for the weather forecast; and WHEREAS, the Morro Bay City Council voiced concerns regarding the City's liability for the operation and dissemination of marine weather information; and WHEREAS, other California ports and harbors have discontinued this public service only because of the liability; and WHEREAS, Morro Bay City Council Member Novak worked with Assemblyman Bordonaro creating legislation to help California ports, harbors, and special districts provide a valuable public service and solve the liability issue; and WHEREAS, Assemblyman Bordonaro has introduced AB 2342; and WHEREAS, AB 2342 reads as follows: "A public entity is not liable for personal injury, property damage, or wrongful death arising as a result of the dissemination of marine weather.information, forecasts, or advisories"; and WHEREAS, AB 2342 includes all California ports, harbors, and special districts. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City 'J"!" Ar::-J::o Grande, hereby finds AB 2342 benefits all public entities, such as the City of Morro Bay, disseminating marine weather information, forecasts, or advisories; and BE IT FURTHER RESOLVED that the City Council of the City of Arroyo Grande supports AB 2342 as introduced by Assemblyman Bordonaro.
