RESOLUTION NO. 3139
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ARROYO GRANDE PROVIDING THE INTERPRETATION
THAT OPEN SPACE AND CONSERVATION ELEMENT
POLICY 1.4 APPLIES ONLY TO PROPERTIES ZONED OR
DESIGNATED IN THE GENERAL PLAN FOR
AGRICULTURAL PURPOSES
WHEREAS, on May 20, 1990, the City Council adopted the Open Space and Conservation
Element (OSCE) of the General Plan; and
WHEREAS, Policy 1.4 of the OSCE discourages use of agricultural water rights as
justification for conversion of agricultural properties to urban or rural residential uses; and
WHEREAS, Mr. Burtram Johnson, on behalf of Tatsumi Kawaoka submitted a request for
interpretation of Policy 1.4; and
WHEREAS, the City Council, after due research and deliberation finds that:
1. The goals and policies of the OSCE are designed to protect agricultural lands from land
speculation and reduce the pressure for urbanization.
2. It is the intent of the OSCE to retain and protect only lands zoned or designated in the
General Plan for agriculture.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Arroyo
Grande hereby makes the interpretation that OSCE Policy 1.4 applies only to lands zoned or
designated in the General Plan for agricultural purposes.
On motion of Council Member Lady , seconded by Council Member Fuller , and
by the following roll call vote, to wit:
A YES: Council Ml2mbers Lady, Fuller, and Mayor Dougall
NOES: Council MI2mber Brandy
ABSENT: None
ABSTAIN : Mayor Pro Tern Souza
