RESOLUTION NO. 3104
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ARROYO GRANDE ADOJ'TING A NEGATIVE DECLARATION FOR
AN ORDINANCE AMENDING TITLE 9 OF THE MUNICIPAL CODE
TO ESTABLISH REGULATIONS FOR ADULT BUSINESSES
LJ WHEREAS, on September 26, 1995, the City Council of the City of Arroyo Grande ("City
Council ") directed staff to prepare an ordinance establishing regulations for adult businesses in
the City; and
WHEREAS, City staff prepared a proposed Ordinance of the City Council of the City of Arroyo
Grande Amending Title 9 of the Municipal Code to Establish Regulations for Adult Businesses
("the project"); and
WHEREAS, the project is subject to compliance with tile provisions of the California
Environmental Quality Act ("CEQA"); and
WHEREAS, City is the lead agency for the project pursuant to Section 15367 of the CEQA
guidelines; and
WHEREAS, City prepared an initial study for the project dated October 6, 1995 ("initial
study"); and
WHEREAS, based on the information contained in the initial study for the project, a proposed
negative declaration has been prepared for the project in conformance with Section 15071 of the
CEQA guidelines; and
, WHEREAS, on October 17, 1995, the Planning Commission of the City of Arroyo Grande
i conducted a public hearing on the initial study and proposed negative declaration, found that the

i project would result in no significant impact,to the environment, and recommended that the City
'- J Council adopt the negative declaration; and
WHEREAS, public notice and a public review period for the proposed negative declaration was
given as required by law; and
WHEREAS,- on November 14, 1995, the City Council held a public hearing on the initial study
and proposed negative declaration.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Arroyo Grande
that:
1. The above recitals are true and correct and constitute findings of the City
incorporated herein' by this reference.

2. The City does hereby certify that it has reviewed and considered the information
contained in the initial study for the proposed negative declaration and the comments received
during the public review and hearing process prior to considering the project.
3. The City hereby approves the negative declaration in accordance with the
requirements, criteria, and procedures of CEQA based on the finding that there is no substantial
evidence that the project will have a significant effect on the environment.
4. The City Clerk is directed to file a Notice of Determination promptly upon , I

approval of the project. I
