RESOLUTION NO. 3097
A RESOLUTION OF APPLICATION BY THE CITY
COUNCIL OF THE CITY OF ARROYO GRANDE
ADOPTING A NEGATIVE DECLARATION CONCERNING
THE CITY'S REQUEST THAT THE LOCAL AGENCY
FORMATION COMMISSION TAKE PROCEEDINGS FOR
A SPHERE OF INFLUENCE AMENDMENT LOCATED
SOUTH OF THE CITY
WHEREAS, the City of Arroyo Grande desires to initiate proceedings pursuant to the
Cortese-Knox Local Government Reorganization Act of 1985, commencing with Section 56000
of the California Government Code, for a Sphere of Influence Amendment; and
WHEREAS, the territory proposed to be included as part of the Sphere of Influence
Amendment is uninhabited, and a description of the boundaries of the territory is set forth in
Exhibit" A" attached hereto and by this reference incorporated herein; and
WHEREAS, the City Council ~as reviewed this project in compliance with the California
Environmental Quality Act (CEQA) and has determined a Negative Declaration can be adopted;
and
WHEREAS, the City Council conducted a noticed public hearing on October 10, 1995
at which time public testimony could be accepted on the proposed Sphere of Influence
Amendment and Negative Declaration; and
WHEREAS, the reasons for the proposed Sphere of Influence Amendment are as
follows:
1. The City wishes to promote commercial and industrial developments;
2. Limited vacant land is available within the City of Arroyo Grande for commercial and
industrial development; and
3. The Sphere of Influence area will provide sufficient space to support future commercial '.--.-.'
and industrial developments;
NOW, THEREFORE, the City Council of the City of Arroyo Grande hereby:
1. adopts a Negative Declaration for this project;
2. approves initiation of the sphere change as a project pursuant to CEQA;
3. instructs the City Clerk to file a Notice of Determination; and
4. makes a request to the Local Agency Formation Commission of San Luis
Obispo County to forthwith begin proceedings for the Sphere of Influence
Amendment of territory as described in Exhibit "A", according to the
terms and conditions stated above and in the manner provided by the
Cortese-Knox Local Government Reorganization Act of 1985.
